Victim Of Stalking & Violent Crime Shares Her Harrowing Story In Support of Lifetime Protection Bill

The Tennessee State Senate unanimously passed the Lifetime Order of Protection Bill this week. The final vote will take place on Monday, March 15th on the House Floor.

This bill is to help prevent victims of violent crimes from being re-victimized.

My situation is only one example of why this legislation is needed here in TN. Unfortunately, there are other victims of horrific crimes in our state who need help also.

On April 2, 2009, my life was turned upside down. Completely Shattered. My husband Ben was murdered in front of me by a man who was stalking me. This man’s name is Hank Wise. My husband and I were inside a restaurant and my stalker showed up out of nowhere. My husband had already asked him to leave me alone about a month prior. I realized at that point that I was being stalked. I asked management to remove him from the establishment.

When management confronted him and asked him to leave, he pulled a .45 from under his jacket and came up behind my husband, shot him in the head, then stood over Ben and continued to fire 6 more rounds into him. In front of myself, 50 witnesses and security cameras.

A lifetime order wouldn’t have done anything. I’m sorry for the loss but these orders are worthless. They only restrain people who aren’t dangerous.

You should probably read the piece she wrote and look at the bill. The bill clearly says that the lifetime order of protection can only be taken out against a CONVICTED VIOLENT FELON where the person petitioning is the actual VICTIM or victim’s family. 1st degree murder, 2nd degree murder, rape etc...Key word is CONVICTED. Also, if you notice at the end of her piece she talks about the importance of having a backup plan, because in reality it is only a piece of paper. She knows that. She carries a gun. Having this LOP on record isn’t a bad thing. It can be helpful in court if the victim has to defend themself against the offender. So Not useless.

If the person is a convicted violent felony offender, what are they doing on the street to be able to stalk and commit more violence?

Unfortunately, violent offenders are let out of prison. So yes, you are correct, they can potentially stalk and kill again. That is the sad reality of “the system” that is in place where there is no real justice. So victims have to resort to things like this.

I’m sorry but protective orders must expire. If the person who it was against served their time, there should be no life time attachments. If a so called victim feels threatened go to the Judge, make your case and get a new order. Does anyone really think a protective order or gun ban would stop a determined individual. If you take it one step further, if the individual was smart, had resources and time to plan the victim would never see it coming.

I worked in uniform for 25 years in NY State's prison system, so I know you are absolutely right. Today, no criminal does the time for the actual crime they commit. Plea bargaining lets them off easy, and puts them back on the street to revert to their old ways. I retired in 2003. I wouldn't want to be working in NY State's prisons today. It was a revolving door back then. It can only have gotten worse.
