Homeowner Now Homeless Because of NY COVID Law

Shawna Eccles owns a house in Brooklyn, but she lives out of her Toyota.

The reason? New York’s Democratic legislature — which has long been hostile to landlords — passed a law during the coronavirus pandemic that prevents homeowners from evicting deadbeat tenants from their properties.

Eccles told the New York Post that her tenant has refused to pay rent for over seven months. But because Eccles still had to pay the mortgage, property tax and utilities on the home, she had nothing left over to cover her own housing needs.

“If anything gets cut off, it will be considered an illegal eviction,” she told the Post. “I have no additional funds to rent an apartment.”

In December, Democratic Gov. Andrew Cuomo signed into law the COVID-19 Emergency Eviction and Foreclosure Prevention Act of 2020. This law imposed a moratorium on residential evictions until May 1, 2021, “for tenants who have endured COVID-related hardship,” according to the governor’s official website.

That is right. I remember as a kid thinking how the whole commie ‘moving people into your house’ thing would work here in America. Yep, you get moved out. I wonder who thought THAT up?

I have a friend from Argentina, fled to the USA over two decades ago. Is an entrepreneur and owned some low-rise apartment buildings with his partners.

They employed some rather large men, to help deadbeat renters decide to move out. That’s when my friend thought it better to sell-out his share. In his view, the USA is heading the same direction as Argentina, because government acts the same, which means that’s how you collect rents there too.

Lots of deadbeat renters are going to be real surprised when they get bills for the entire back rent due upon receipt the day the moratorium is lifted.

If rent is a thousand a month, and they don’t pay for a year, I can write that off as a loss on my taxes for 2021.
If I suffered a loss, then they had a gain of 12K, they gonna have to pay taxes on the 12K?

This is what happens when simpletons in government regard all landlords as Ebenezer Scrooge or Mr. Potter. What they always manage to do well is created unintended consequences.

There is a program for NYC tenants that helps them with their rent. Shawna Eccles should have notified her tenants. She should also park in front of cuomo’s house.

The left doesn’t care about the renters. It does care about eliminating private property as it would in a communist paradise, which is where this is heading. The left took full advantage of the crisis to implement one of their favorite wishes: stripping property owners of their property. The left has stolen property from property owners. An owner doesn’t own property when he/she is forced to provide an apartment to someone with no recompense.

The government did not have the right to invalidate the terms of a legal contract, “allowing” the renter to live rent free. Doesn’t matter if there was an executive order or not. It has no right to do that.

Do you seriously think that when this is over, the tenants are going to all pay their rent on time, plus back rent, plus the penalties that are agreed upon in the valid legal renting contract? Of course not. Most will not be able to pay, and the entitled crowd will go out in the streets with “CANCEL RENT” signs and the politicians will forgive the rent, leaving the owners with big bills and the obligation to keep the heat and lights on, and to work like a slave to pay the mortgage, taxes and insurance.

The left wins big in this. It has destroyed a substantial portion of private property and conditioned the folks to expect favors from the government.

Who loses, is the people who worked hard to buy property and now have had it stripped from them. Do you think an owner can sell property that has renters on it who are not paying rent? No you cannot sell it.

Who gains, is the folks who were renting and who lived rent free.

I’ll keep the rest of my thoughts to myself, since they involve scatalogical deprecations upon the legislators and government in general.

There is nothing more evil and communist than these eviction laws that deprive people of their property and their lively hood. Even to the point of what this women is facing.

Now imagine this. The IRS may not let this women claim her losses here against her income. They consider them passive losses. As far as the IRS is concerned the losses are her own fault.

Landlords here are being forced to pay the tenants rent irregardless of if the tenant has the money to pay or not. Small landlords are left penniless, and stand to lose it all. And they can’t even sell out. They are completely trapped by this evil. The tenant can also openly destroy the property, and the landlord has no recourse. All they can do is sit and watch. And if the tenant breaks sanitary laws by say piling up garbage then the landlord is responsible even though they can’t legally do anything about it.

People, we are living in the face of pure evil.
