Judge dismisses lawsuit by Democratic AGs to recognize ERA

A federal judge on Friday dismissed a lawsuit filed by three Democratic state attorneys general that had sought to force the federal government to recognize Virginia’s vote last year to ratify the Equal Rights Amendment and add it to the Constitution.

Shortly after Virginia became the 38th state to ratify the amendment that supporters say will guarantee women equal rights under the law, the archivist of the United States declared he would take no action to certify the amendment’s adoption, citing an opinion from the Department of Justice under the Trump administration.

Constitutional amendments must be ratified by three-quarters of the states, or 38, but Congress enacted a ratification deadline for the ERA that passed decades ago.

This case is one of the reason the Demon-crats want to pack the Court.

and packing the court is a real possibility now that we lost the senate.

but, man, that boycott in the runoff made us feel really good about ourselves, so what’s the bother of a life under tyranny?

...argued that the deadline, which was first set for 1979 and later extended to 1982, was not binding.

Of course it's binding. The Supreme Court's 1921 decision in Dillon v. Gloss makes it binding.

What is this sex business that the Equal Right Amendment refers to? That is such a 20th century concept. Truly progressive thinking makes this total nonsense. Likewise any violence against women acts that are on the books.

We already have laws on the books prohibiting sex discrimination. That is one of the reasons it did not pass. Another reason is that it became clear that the ERA would require that women be drafted the same as men and that they be treated the same in the military. People did not want their daughters to be drafted, particularly given that we were still in Vietnam.

The original deadline was part of the amendment’s proposal. It had passed both houses of Congress by 2/3rds majority as required. When the ERA failed to get the required 38 states’ ratification after seven years, Congress extended the deadline until 1982 by simple majorities in both houses. The law doing this was signed by Jimmy Carter (who may have to be content with being the third-worst President in recent memory).

And the ERA failed to get any more states to ratify it, as well as several states rescinding their previous ratification. For those not around then, people started bringing up things like gay marriages, men in women’s restrooms, etc that people of the time thought of as just downright crazy.

Keeping up with a common theme amongst leftists, the rules don’t really apply to them. Time has expired on a proposed Amendment? So what? Votes come in without verification? So what?

Virtually everything we were warned of if the ERA were to pass has come to pass even though ERA failed to be ratified.

Unisex public bathrooms, etc.

And now, thanks to the man many of suburban women voted in, they now get to have their daughters compete against biological men in sports!

Won’t it be fun to endure your daughter having to shower with the guys after a run or game?!

If I were a teenaged boy, I could think of no better way to see naked, or barely dressed, girls than to “self-identify” as a girl. It’s like an “all-you-can-...see” buffet.
