South Carolina Has Chance to Pass Open Carry Law

U.S.A.-(AmmoLand.com)- There are only five states which currently ban the open carry of handguns in most public areas, most of the time. They are: Illinois, New York, California, Florida, and South Carolina. New Jersey and Hawaii ban open carry in practice, but legally, anyone with a permit can open carry. It is just extremely difficult to obtain a permit.

South Carolina is moving toward restoring the right to openly carry handguns in public with House Bill 3094, labeled “Open Carry with Training”.

The bill is reasonably easy to read and understand. From scstatehouse.gov:

TO AMEND SECTION 23-31-210, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ISSUANCE OF CONCEALED WEAPON PERMITS, SO AS TO ENACT THE “OPEN CARRY WITH TRAINING ACT” BY REVISING THE DEFINITION OF THE TERM “CONCEALABLE WEAPON” TO ALLOW A PERMIT HOLDER TO CARRY A CONCEALABLE WEAPON OPENLY ON HIS PERSON; AND TO AMEND SECTION 16-23-20, RELATING TO THE CARRYING OF A HANDGUN, SO AS TO PROVIDE A PERSON WHO POSSESSES A CONCEALED WEAPON PERMIT MAY CARRY IT OPENLY ON OR ABOUT HIS PERSON IN A VEHICLE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. This act may be cited as the “Open Carry With Training Act”.

SECTION 2. Section 23-31-210(5) of the 1976 Code is amended to read:

“(5) ‘Concealable weapon’ means a firearm having a length of less than twelve inches measured along its greatest dimension that must may be carried openly on one’s person or in a manner that is hidden from public view in normal wear of clothing except when needed for self-defense, defense of others, and the protection of real or personal property.”

South Carolina has been attempting to pass permitted open carry for a while.

The major obstacle is the Senate Republican leadership.

I wish they honored my Utah carry or my PA carry permit. Every time I go to SC I have to be unarmed just like when I’m in NJ.

I live in SC which is definitely a gun friendly state. SC reciprocates with only 17 states. My understanding is that licensing and training standards preclude reciprocation with other states. I have procrastinated getting licenses from other states, Utah being one.

I think, however, you can possess a weapon in your car and abode. At least that’s something.

I live in SC. I have become a fan of conceal carry, I wasn’t at first. I can go along with open carry as long as they keep conceal carry. I like the idea of one not being sure who is carrying and who isn’t.

I noticed the hammer wasn’t locked back but I just don’t know enough about the 1911-style gun to voice an opinion. I know there’s a safety-type lever on the back of the grip, but that’s about it. (It IS a 1911-type gun, right?)

No. Not everyone agrees with condition 1 carry. I do but then there is room in the family to have different opinions. The important thing is to exercise our rights often.

To me, the most dangerous part of that is lowering the hammer. If you slip it better be pointed in a really safe direction. I prefer decockers or Glocks or similar.

A valid point, but I think some folks just make snatch-and-run targets of themselves. That would be spun as anti-open carry by the media. Granted, striker fired handguns make it more difficult to determine condition of carry.

My understanding about “gun friendly” SC is that full auto weapons are 100% banned for anyone except police

Extremely difficult should read nearly impossible. The unconnected in New Jersey have near zero chance of obtaining a permit. You must prove a need to carry, and the proof is never sufficient.

What do they fail to comprehend about "shall not be infringed" anyway?

Agree, I sit in the mall reading, just an old guy on a bench, no threat....with 18 live rounds, a laser sight and weekly practice at the range under my belt. As soon as I open carry, I’m not the threat, I’m the first target of the bad guys. Open carry is BLING..look at me, I’m important I have a big gun...and I would be certifiably STUPID letting everybody know. SURE it is my constitutional right to open carry. So what, I’m armed and lethal. What is the need? I gave up playing cowboy about 70 years ago.

True point. Lowering the hammer on a 1911 can make the moderately competent be very aware. I use the term moderately competent because I would never say I am as skilled as the professional shooters or SOCOM guys. Have used my various 1911 for over 30 years.

Lowering the hammer takes practice, patience and focus on what your doing. Love my 1911s but I do not use them as my EDC.

Excellent. Since I live just over the border and the gun range I always go to is in South Carolina, it always struck me as strange that they don’t allow open carry. Fortunately they have CC reciprocity with North Carolina.
