Arizona lawmaker introduces bill to give Legislature power to toss out election results
The Republican chair of Arizona’s state House Ways and Means Committee introduced a bill today that would give the Legislature authority to override the secretary of state’s certification of its electoral votes.
GOP Rep. Shawnna Bolick introduced the bill, which rewrites parts of the state’s election law, such as sections on election observers and securing and auditing ballots, among other measures. One section grants the Legislature, which is currently under GOP control, the ability to revoke the secretary of state’s certification “by majority vote at any time before the presidential inauguration.”
“The legislature may take action pursuant to this subsection without regard to whether the legislature is in regular or special session or has held committee or other hearings on the matter.”
A request for comment from Arizona’s secretary of state was not immediately returned.
Not likely, but it could open the floodgates. Then what?
It’s for future elections.
Not that it’s needed because the Constitution already mentions the right of the state legislatures.
Seems like a state could do that before Congress counts the electoral votes and people have an opportunity to object to them. After that, federal law says the winner at the end of the process is president and a state law can’t override federal law.
Must be another election coming up for these losers who let Trump be removed without a fight. After the fact posturing by gutless reps. Primaries for everyone!
If I read the SC decisions on this matter correctly, the Supreme Court has Already declared in at least 2 rulings, that the State Legislature can Exercise Their Plenary Authority and choose their own Electors whenever they want if they can demonstrate Their Election Laws were Violated in any way.
Sounds like they are fighting to do what is RIGHT for Arizona voters

One of the State Senators said in an interview that there are a couple of never Trumper Rs in both the Senate and House. They could block any de-certification vote.

Sometimes it takes one state to show the way before other states follow. I wonder if the court will follow the Supreme Court’s precedent of denying the prohibition of Trump’s plan for the U.S. Census as too premature. Any lawsuits that challenge this bill must prove “harm.”
Disenfranchising the voters of the state just because the legislature doesn't like the election results? I think showing harm would be the least of their problems.

That possibility was sent to Republican activist right after election. Nothing happened.
They already have the power this bill addresses. What they don’t have for the majority of legislators is something to give the cowards cover when this happens again. The US Constitution already gives the legislators this power, independent of any other state entity.

All swing state legislatures, which are almost all controlled by the GOP, should pass such legislation.
If they don't, the Dems are going to steal everything including everything that is nailed down.

Yes, but this bill is NOT retroactive. So, it’s pretty useless for the November 3,2020 election.
Does AZ election law have to be referred to the public for approval like GA does? If not, it should be added in the State’s Constitution.
