When it comes to social change, courts are the preferred approach.
1. It sounds fair when “a court decides” in favor of some sympathetic plaintiff.
2. Court rulings are filled with big words and sound smart.
3. There’s no appeal, ever.
4. Even if the ruling is eventually reversed, society will have “moved on” by the time that happens.
Absent an Article V convention, Scotus issues edicts that only future courts can (rarely) overturn.
We used to be self-governing.
It is lost past time to do an end run around our masters.
