Sen. Rand Paul plans to force a test vote on Tuesday that will show how many Republicans support holding an impeachment trial for former President Donald Trump and how many believe a trial should not take place.
Paul, a Kentucky Republican, told reporters he's going to force a procedural vote on the constitutionality of a Senate trial. The vote is expected to take place Tuesday afternoon after senators are sworn in as jurors.
"I think there will be enough (votes) to show that more than a third of the Senate thinks that the whole proceeding is unconstitutional, which will show that ultimately they don't have the votes to do an impeachment," he said.
The Democratic-led House has already voted to impeach Trump, charging him with incitement of insurrection for the attack on the Capitol that left multiple people dead. But two-thirds of the Senate would have to vote to convict Trump after a trial, an extremely high bar to clear.
The vote Paul plans to force will effectively put senators on record as to whether they believe a trial of a former President is constitutional.
Paul said: "Democrats insist on applying a test of incitement to a Republican that they refuse to apply to themselves. I want Democrats to raise their hands if they have ever given a speech that says 'take back,' 'fight for your country,' who hasn't used the words fight figuratively?"
He went on to say, "Are we going to put every politician in jail -- are we going to impeach every politician who has used the words fight figuratively in a speech? Shame!"

No not every politician.....just the conservative republican ones.....or any others that oppose this communist regime.
Sen. Paul has become one of the few Republican champions evincing respect for the Constitution. Perhaps others in his Party will learn from his example and conclude that whether or not they liked President Trump the Constitution trumps their personal feelings and compels them to object to an unconstitutional action by a Democrat controlled Senate.
It's the leader's job to expose this folly, but Mitch is awol.

You couldn’t be more correct. The whole trial is a sham since Trump is not POTUS. Rand is wisely flushing out the RINOs.
Good for Rand Paul... let's keep this stuff transparent. Out the Benedict Arnold's of our party. If they're not representing the people who elect them - those people have a right to know that...

The Constitution states a “quorum” regarding a trial in the Senate.
50 Democrats can show up and legally state a quorum and the Senate trial of Citizen Trump can take place.
The Republic is doomed... that’s why there is no mention of America, Americans, north American continent or anything else in the Bible.
