A precedent had been set when a judge was impeached awhile back. The constitution allows this.

There really needs to be something done about these ‘lifetime’ Congressional positions. ...my gosh they should have retirement standards like the rest in the nation. Sheesh!.....
I listened to Leahy today and wondered if he’d even get his next breath!

Assume for the moment that this “sham trial” goes forward, does Leahy, as the presiding “judge”, having a vote in any of the proceedings?

It would appear to me that he would not have a vote because he is supposed to be sitting as a neutral party.

If I am correct, then the Senate will be divided 50 R’s and 49 D’s. Kamala can not vote, both because she is not presiding over the trial and because, if a vote is 50-49, there is no tie to break.

Any legal beagles out there that can respond to this issue?
