The Supreme Court would have to rule that this kind of law is unconstitutional, because it’s a clear and obvious violation of freedom of speech and freedom of assembly. I don’t think this legislation would even get 60 votes in the senate to survive a filibuster. I doubt that the democrats would trash the filibuster over dumb legislation that’s going to be struck down by the courts. If it did somehow get to Biden, he’d be making a huge mistake to sign it. He’s already made one really dumb move by declaring that half of all Americans are “domestic terrorists”. If he signed this kind of law, he would be on his way out the door in 2024.
If this “legislation” actually was passed and signed by Biden, the SCOTUS would have to strike it down, otherwise the court would lose all legitimacy and moral authority. If they let this kind of law stand, that would effectively be the end of the Supreme Court as a meaningful institution. But I strongly doubt that this “legislation” would ever pass in the senate, as it’s clearly unconstitutional.
