The VP presides and the Senate and House decide.

It’s time to test the constitution.
Pence will do it. His faith leaves him NO option.

Think about this folks. If the VP gets to decide what votes to count, what about the next election when the VP is a democrat?
After Biden/Harris, how many Republican Presidents do you see getting elected...regardless of Pence’s actions?

Meant to add, especially if GA “elects” 2 democrat Senators today.

Think about this folks. If the VP gets to decide what votes to count, what about the next election when the VP is a democrat? Do you really want the VP to have the power to determine the next president? Oh, I know, he said “fraudulently selected”, but seriously, that gives the VP the power to decide who is “fraudulently selected” and that means the VP has the only vote that counts in the next election.
What is being suggested is that VPOTUS refuses to accept the electors, and demands that the state legislatures decide which slate of electors is correct, and if state statutory laws were followed. That is in accordance with the U.S. Constitution that state legislatures appoint the presidential electors, not governors, or state courts. It also removes the Congress of the judge or these elections, and kicks it back to the proper constitutional bodies. The present time schedule, with state legislatures out of session after Election Day, is rather compressed, and doesn't allow sufficient time for legislatures to investigate and act. That could change in the future.

Hmmm...mquinn or Mark Levin?
....mquinn or Mark Levin?
I think I’ll go with Mark Levin.
Doesn’t mean that Pence will do the right thing, but he does have authority to do so.

Strange. As of this post, Twitter hasn’t flagged his comment.

That has already been adjudicated in state and federal courts.

Expediency can always be used to justify almost any action. I could see your position as justified if any court had supported these challenges. No court will support this fantasy.

“Fraudulently chosen electors” - electors NOT chosen by the State Legislatures.

The VP presides and the Senate and House decide.
The Constitution reads that VPOTUS as President of the Senate presides, and the Senate and House witness the vote. It says nothing about the Congress deciding the election, other than the contingent election procedure if no candidate receives a majority for POTUS or VPOTUS. The decision for the appointment of presidential electors remains with the state legislatures. VPOTUS will give them the choice of certifying the correct slate of electors by appointment, or having no votes counted. It is their choice, and their responsibility, not the Congress. Statutory law to the contrary is likely unconstitutional.

How many courts have even listened to the *merits* of the various cases?

No, decisions by the courts that complaints were premature, parties had no standing to bring them, were estopped by laches, or became moot are not adjudications on the merits. Even if they were, nothing stops the state legislatures from reversing certifications and/or appointing different electors prior to the time they are counted. VPOTUS might facilitate that review in the state legislatures.

I’ve asked on this forum whether Mark Levin had weighed in on the question of the scope of the Presider’s —in thus case Pence’s —- authority, but have not received a reply. If you can direct me to where Mark weighed in on this question, I would greatly appreciate it. God bless.

A precinct election officer can refuse to certify their vote totals due to irregularities.
A County election officer can also refuse to certify.
Secretaries of state can also refuse to certify.
Governors are the final pass at the state level of vote total integrity.
At each level... certification means that the people’s vote was secure.
Why is it then that the vice president does NOT have the power to refuse certification on fraudulent grounds???
What happens when it is proven after the fact that fraud DID occur, and that everyone in the process of certification KNEW ABOUT IT, and did nothing?
yeah... thats right... they can be prosecuted.
If Pence certifies, he’s just as guilty as Kemp.
Therefore, he should have the power to refuse certification... FORCING every single state to go on record (via the legislatures) as to the selection of the president.
Unfortunately, it looks like even that will not save us from traitors in the GOP.

Ok, so let’s say that the election remains stolen and all your constitutional rights are reinterpreted, violated and abrogated by a corrupt communist regime. Do you just live with it, or do you pick up a gun and fight?

If you don’t have standing, then merits don’t count for much? If the courts had thought it worthwhile, they would have figured out a way.
