Senate confirms Barrett replacement on federal appeals court

The Senate has confirmed an Indiana prosecutor to replace Supreme Court Justice Amy Coney Barrett on a federal appeals court based in Chicago.

Thomas Kirsch, who currently serves as U.S. Attorney for the Northern District of Indiana, will replace Barrett as a judge on the U.S. Court of Appeals for the 7th Circuit. Kirsch was confirmed Tuesday on a 51-44 vote.

Three Democrats — Arizona Sens. Kyrsten Sinema and Mark Kelly and West Virginia Sen. Joe Manchin — voted for him in what was otherwise a party-line vote. Four Republican senators and Vice President-elect Kamala Harris did not vote.

The Senate Judiciary Committee has its hearing for President Trump’s nominee (Raúl Arias-Marxuach) for the vacancy on the 1st Circuit Court of Appeals tomorrow at 10:00am. I don’t know if they can (under Committee rules) vote to advance the nominee to the full Senate in the same committee meeting but should if they can.

And President Trump should name a nominee to the remaining 7th CCA vacancy... just in case. A good candidate would be Judge Holly Brady who sits on the US District Court for the Northern District of Indiana. She’s young and the DemocRATS hate her based upon her confirmation vote for her current position.

As it has turned out, the five “conservatives” on the court are toothless tigers. I did not understand why Alito and Thomas said they would hear the Texas case but that they would not grant relief to the defrauded.

They didn’t say that. It’s proper to not issue an opinion until you hear the case. This was a vote solely on whether to take on the case for heating.

Thayer good to hear on the 1st Circuit nominee. You always have the scoop on that stuff.

I didn’t think they’d be able to get to him. If they’re having a hearing they’ll likely have a vote. But time’s running out. Christmas is next week and the Congress is over on the 3rd.

Though there’s only 7 judges awaiting votes on the floor. They can get those done easily.

That would be 238 judges total of they get through them all.

Does it matter? As Rush said today, judges want to be liked. They want to be invited to the right parties. Now, they also fear being doxed and having their families threatened. Judges are not going to save us.
