What if Trump refuses to concede *EVER* ?

The electoral college votes on Monday. Congress confirms the electoral college vote in January.

So, what to do?

The Supreme Court will most likely rule that this is a political question that should be decided by the legislatures of Pennsylvania, Georgia, Michigan, and Wisconsin because the Constitution states that each state Legislature shall select the electors.

So, The SCOTUS will pass the buck back to the politicians in the four states.

This means that the Legislature of each state should investigate the election and make the decision.

Well, And this is the ingenuity of the suit - it banks on the SCOTUS being as cowardly as the lower courts ( and they WILL BE. They don’t want this election to be on their shoulders).

The remedy is black-letter, constitutional, and convenient.

If the state legislatures fail, then it goes to the House of Representatives.

n other words, in the end, to use a basketball analogy, the final foul shots will have to be fired by the LEGISLATURE, not the courts.

The legislatures of each of the 4 problematic states are MAJORITY REPUBLICAN! It remains to be seen if after seeing the evidence of fraud presented, they will be convinced to choose electors who will favor Trump ( Too many Republicans hate Trump’s guts anyway ).

The most complicated result is if the electors are not unified and divided in their view and the Electoral College results in a 269-269 tie!

he genius of the framers of the Constitution is that they still have an orderly process put in place. If worse comes to worst it results in an electoral tie, the US House of Representatives - Congress gets to vote for the President.

Under the Constitution’s 12th Amendment, the House would select the next president and the Senate would pick the vice president if no candidate has a majority of Electoral College votes.

It all depends on how the legislators of each of the 4 problem states will choose electors.

If the state legislature looks at the evidences and his convinced of the massive scale of fraud, and decide to choose electors who will vote for Trump, it is still possible.

Though the House has a Democratic majority, such an outcome would almost certainly benefit Trump. Here’s why: In a concession to small states concerned their voices would be marginalized if the House was called upon to choose the president, the founders of thus country gave only one vote to each state.

House delegations from each state meet to decide how to cast their single vote.

That voting procedure gives equal representation to California – population 40 million – and Wyoming, population 600,000.

This arrangement favors Republicans. The GOP has dominated the House delegations of 26 states since 2018 – exactly the number required to reach a majority under the rules of House presidential selection.

HIS HAS HAPPENED TWO TIMES IN AMERICAN HISTORY...

The founders proved prescient: The elections of 1800 and 1824 did not produce winners in the Electoral College and were decided by the House. Thomas Jefferson was chosen in 1800 and John Quincy Adams in 1824.

All the above discussion of course, assumes the the Electors chosen by the 4 problem states will NOT select Biden. We don’t know that. All we know is that the Legislature of these 4 states are MAJORITY REPUBLICAN.

Congress can also challenge those electoral votes on Jan 6th. It takes one house member and 1 senate member to open debate and challenge. Rep Mo Brooks is planning on doing so.

He suggested writing your Senator which I am gong to do ted Cruz and ask him to challenge. Listen this is from December 8th but I heard Mo Brooks say this weeks ago in an interview
