Trump as POTUS, or Pence as VPOTUS, could try to claim a right under Article III to the court's original jurisdiction, but that is unprecedented. That depends on interpretation of the word consul
, or the interaction of the Declaratory Judgment Act with the Eleventh and Fourteenth Amendments.

Trump filed a motion to intervene in the Texas case as a Presidential Candidate; but that was declared moot when the Black-robed cowardly tyrants pulled a non-existent “lack of standing” out of their ass.
