Montana’s Governor, Attorney General File Opposing Briefs to Texas Supreme Court Lawsuit

Montana Gov. Steve Bullock is opposing a lawsuit filed by the state of Texas challenging the 2020 election results in four states.

Bullock filed a brief, docketed late Thursday, in support of the defendant states—Pennsylvania, Georgia, Michigan, and Wisconsin—arguing that the Supreme Court should reject Texas’s request to sue.

Montana is one of the states in which President Donald Trump won by a large margin in the November election. Bullock, a Democrat, argued that Montana, like the four defendant states, had expanded mail-in voting in the 2020 election, which means the outcome of the Texas case would impact the results of the election in his state.

He also argued that bringing a lawsuit in the Supreme Court “was not a procedurally appropriate way to challenge state election laws.”

“As this Court has repeatedly emphasized, challenges to state election laws should occur in an orderly fashion, on a non-emergency basis, well in advance of elections, according to ordinary rules of civil procedure,” Bullock wrote (pdf).

“They should not be raised in the Supreme Court, on an emergency basis, in an effort to overturn the result of an election that has already occurred.”

He went on to say that attempts to challenge the election results on a state-by-state basis had also proven to be unsuccessful, citing lawsuits brought by the Trump campaign in Montana before the election to challenge Bullock’s order to expand mail-in voting.

However, Montana Attorney General Tim Fox, a Republican, joined with the 17 other states and territories with Republican attorneys general who have filed amicus briefs in support of Texas.

Actually, you can’t file a lawsuit if you’re not claiming harm. And until the mail-in ballots were used and counted incorrectly, Texas was not harmed.

They did bring it to the SCOTUS before the election, the SCOTUS kicked the can down the road. And here we are. However, I fully expect the SCOTUS will duck their responsibilities here. This is a watershed moment that will change this country forever, and not for the better.

Expanding MV wasn’t the issue he just argued. Doing in in a way that ends the secret ballot, eliminates chain-of-custody, and prevents fair and honest transparency in the counting is.

That is generally unconstitutional and therefore federally unconstitutional unless changed by their legislatures. They weren’t. It was abusive, dictatorial Bolshevik governors and attorneys general, secretary of states, and health directors that conspired to deny the right of other States’s citizens. Cut and dried. Let’s see if logic still works or are we a Cuban kangaroo court.

Bullock is a lame duck rat. This is just an FU to Montana as he walks out the door. The incoming Gov, Gianforte seems pretty solid, but isn’t sworn in until early Jan.

I agree. Not holding out much hope that the Supreme Court will remedy the problem. And in doing so, they will forever change not only their own court because the Democrats have been pretty clear that they will pack the court to forever swing it left. As well as allowing an obvious stolen election stand. States will run elections in any fraudulent manner they want and if contested Democrats will immediately bypass lower courts with Trump appointed judges and appeal to the Supreme Court, who will uphold whatever lunacy is sent to them. The two run-off Senate elections are the only thing standing between us and an absolute Democrat run country. If the Supreme Court does not rule in a way that remedies the election fraud, the run-offs in Georgia will be blatant and likely violent.

Bullock had a massive campaign that failed to get one of Montana’s Senate seats in DC. His political adds were aired in our state for some unknown reason and were pure propaganda aimed at retired people and sportsman. He’s a real puke.

I'm no lawyer but I wouldn't think any court could impose a ruling in any case on an entity that is not a defendant in the case.

I'm no lawyer but I wouldn't think any court could impose a ruling in any case on an entity that is not a defendant in the case.

However, I do have some worry that SCOTUS will rule that the suit is invalid because Texas did not file suit against ALL states that violated the Constitution with extra-legislative law.

Many of our AGs and Secretaries of State are Soros agents. George has concentrated his money on getting compatible AGS and Secretaries elected in each state. They are more influential and powerful for his purposes than legislators and easier to get than Governors.
