SCOTUS will not be deciding the election. They are throwing it back to the legislature, as the Constitution requires. it is still the state that will decide.

I actually HOPED that Ohio would join the lawsuit, so that not all the states involved in it would be from the South.
But now quite a few non-Southern states (including neighboring Indiana) have joined the suit, so we’re doing OK so far.

Since Election Day, State and Federal courts throughout the country have been flooded with frivolous lawsuits aimed at disenfranchising large swaths of voters and undermining the legitimacy of the election. The State of Texas has now added its voice to the cacophony of bogus claims.

Yost argues that the elections were illegal due to rules changes by non-legislature actors, but that judges don't get to appoint electors, either. That power is reserved to the state legislatures.
Yost previously sued Broockvar regarding the election rules changes. He's not the enemy.

The SCOTUS lacks any constitutional authority to appoint electors. It can, however, declare the elections in those states void and tell the state legislatures it is up to them. Yost is correct.

it’s not a vote. it comes down to who makes the correct legal argument. I believe Texas has a solid case.
