Justice Samuel Alito agreed on Thursday to review an appeal against the ruling of the Pennsylvania Supreme Court that tossed a suit alleging the state’s mail-in voting was unconstitutional.

This is a positive, real development. Hopefully it leads to something.

A vote will be taken by all the Justices to take on or deny hearing the case.

Usually, a Justice sitting as a Circuit Judge doesn't issue a stay unless he/she thinks the rest of the Court will take the case, AND agree with the claim. The Court wouldn't function if they issued stays based only on their own desired outcomes. Of course, deciding a presidential election is quite a big deal. By issuing a stay, it does buy time. SCOTUS doesn't want to take this case unless it has to do it. It's political, and ultimately, Congress has the power to accept, or not accept presidential electors.

The date is garnering a lot of discussion in many circles.

My understanding Alito setting it the day after safe harbor he actually removes protections of PA and opens PA up to review by congress.

Trump should appeal all cases to the supremes and get dates set after safe harbor. This will allow all those cases to go to congress.

Can Gov. Wolf object and stop or interject his power into that as he did before? Wolf doesn't seem to have any concerns for what Judges say outside those under his control.

I really hope you're not expecting any of the state legislatures involved to have the guts to do the right thing.Pennsylvania's legislature has already made it clear that they don't.

I'm not sure anyone has the guts to do the right thing.

Not really. If they send two sets of electors to congress...congress decides. But then it gets messy.

But GOP holds the advantage if they vote based on party.

The constitution clearly states that all disputes must be resolved by the 8th. The state is under dispute by the state legislatures right now and Gov won’t resolve.>>>. There is no dispute by the state legislature that i know of. This is a suit by Kelly, et all a bunch of state reps that lost in November over Act 77. The legislature did not do any thing before they went home. A few have a letter to the PA reps in congress but that is all.

Good point Dr Franklin. I would think that Trump is very encouraged
about this development. I don’t know Law, but I am a good observer.
The fact that Alito agreed to at least review tells me tells me the basis
for the lawsuit is the sweet spot(Unconstitutional the way PA changed
voting rules in the middle of an election cycle). Otherwise Alito would
not have agreed to review. Am I off on my observation?

No, Circuits were reassigned because Ginsburg died and ACB was confirmed. The only significant change was Sotomayor taking the more prestigious 2nd Circuit previously assigned to Ginsburg. There was no way ACB was getting NY and the 2nd. Amy was assigned the 7th Circuit, where she previously presided, lived and worked.
