Electors certified after the Safe Harbor Date require both houses of Congress to agree that they are legitimate. Otherwise, the slate certified by the governor would be counted under statutory law. Now, SCOTUS might make a constitutional determination that is impossible to ignore, but without an injunction stopping the governor from certifying, this is schedule is problematic.

I am no expert but they might just rule on the laches and remand the real unconstitutionality question back to the PA supreme. Hot potato no one wants.
It means his clerks have not rejected to hear it. Alito and his staff will read and consider the merits. If they decide to set it over for hearing, I think they need 3 other justices to agree to hear it. Then it’s scheduled.
Clearly the USSC Justices are aware of all the lawsuits winding their way to them, so they may want to consolidate all cases to economize on time.
With the level of fraud evident and growing, it’s very likely they are are going to be highly engaged at looking that equal protections were upheld and if not, rule the certifications be nullified. This ruling will lead to comprehensive election reform in the years ahead. And it’s needed. Same playbook used in Atlanta, Philadelphia, Las Vegas, Detroit ....
Today’s shocking video in GA should clearly tip the balance towards nullification not just in GA but in other states that showed similar shutdowns, continued counting, spikes for Biden, all those activities that deny legitimate voters a fair election, violate equal protections. Ruling a nullification of one state should carry over to other states due to similar proven fraud and irregularities.
Upon nullifications leaving neither Biden nor Trump with 270, an order to follow the Constitution taking the election into Congress where a majority of 50 state delegations in the House of Representatives determine who the President-Elect. Trump wins.
Alito’s strategy is simple. He is putting the pressure on all State legislatures to do their job and address the criminal coup heist that has occurred, rise to the occasion, and declare their elections ‘spoiled’ by Criminal Democrat Party fraud and direct their electors to vote for Trump. If that doesn’t happen, the Court will step in with respect to PA. Depending on legislative action, more appeals may be necessary.
PA has already defied Alito twice . . . so Sam can’t be too pleased wif ‘em.
