I thought so too, and the way I interpreted it, the pastor has not exhausted every legal means, OR because of the SCOTUS decision this week which is a win for church gatherings, Alito is sending the message not to waste the SCOTUS time and THAT decision ITSELF will suffice for his case..

This Tony Spell was screwed from the get-go - Odiousbama "judge" Brian Jackson [MD Louisiana] ruled against him.

By the time he got to the Fifth Circuit and a three-judge panel [James Ho - Trump judge, Gregg Costa - Odiousbama judge, Jerry Edwin Smith, Reagan judge], the case was mooted by an expiration of the grubner's order, as noted by the panel [expired a month before, at the time of the appeals court ruling].

The same panel turned down a request for an en banc hearing.

That's why they tried to bounce it to Alito.
