The circuit court is giving Sullivan a chance to decide what to do. If he dismisses it is over. Flynn can sue like crazy. He is probably running out the clock to see if Biden wins. If so, he can continue to oppress Flynn and there will be no bad consequences for the judge. Sidney may not be able to do anything until Sullivan does something. That may be advantageous as she may be very busy now. Once he makes a ruling then she can respond, probably taking up the matter with the circuit court, as I assume he will avoid a dismissal if he can.
