Every challenge needs to be in court by December 8. Then it needs to be settled by the 14th before noon.

The clock is ticking. This is especially true in states with a democratic court system. They will not speed the process along, leaving little time to run through the Federal System.

I am not passing judgement either way, but ....tick tock.

Every challenge needs to be in court by December 8. Then it needs to be settled by the 14th before noon. The clock is ticking. This is especially true in states with a democratic court system. They will not speed the process along, leaving little time to run through the Federal System.

While it is true that the clock is ticking, a technicality should not be an obstacle to justice.

The letter of the Constitution should not be a shield against the subversion of the spirit of the Constitution.

If the fraud is as broad and pervasive as it seems to be, it amounts to a wholesale subversion of the spirit of the Constitution, and SCOTUS must allow justice to prevail, even allowing for changes in the Constitutionally mandated timelines for Presidential succession.

Otherwise all future fraud attempts will succeed if they can use the tight timelines as a "built-in guarantee" against any remedy.

The letter of the Constitution should not be a shield against the subversion of the spirit of the Constitution.

I am not sure that international criminal conspiracy to subvert an election in the United States has a date deadline.

There is a report due on Dec. 18th by Homeland security on the issue. I certainly will reserve my judgement on events until that report is released. Most Americans I am sure would agree that if accusations approve true, then we must proceed to the 12th Amendment.

First of all, I am not an attorney. However, after 20 years as an Army intelligence officer specializing in counterterrorism and counterinsurgency operations, I went to work for the FBI, DOJ and the White House in a similar capacity and had the opportunity to assist US Attorneys and AUSAs in understanding complex evidence and preparing major cases for trial. There are a lot of misperceptions and misunderstanding about how the progression of cases from state to federal courts really works.

While time is short, there is plenty of time for Team Trump’s attorneys to pursue their efforts under Article 2, Section 1, Clause 2, which relegates responsibility for election law to state legislatures - there is no constitutional role for state executives or state judiciaries, and the 14th Amendment (equal protection). Sydney Powell’s pursuits clearly focus on felonious behavior, which will clearly take a great deal more time and involve multiple state and federal jurisdictions.

With respect to what she has stated, Sydney Powell, one of the most respected attorneys in the country, would not have said what she has without very solid evidence. Her comments and more have been echoed by Atlanta attorney Lin Wood, who is probably the most highly-regarded libel attorney in the country. Lin has stated openly that Georgia Governor Brian Kemp and Secretary of State Brad Raffensperger are corrupt and he can prove it. Strong statements for a highly-experienced libel attorney.

I have no idea to what extent Powell and Wood are working together, but it’s abundantly clear that they communicate. I fully expect that their efforts, Powell’s being nationwide and Wood’s focusing on Georgia, involve a broad range of felonies, from official corruption and kickbacks to outright manipulation of election results and related fraud of various types.

While I’m not normally a prognosticator of events without a complete understanding of relevant evidence, I strongly suspect that the Supreme Court will ultimately toss this election to the House of Representatives.
