Bypassing McConnell: Democrats push Biden to aggressively use executive power

WASHINGTON - Democratic senators are calling on President-elect Joe Biden to use executive power to advance goals such as tackling climate change, relieving student debt and creating a more progressive immigration system.

The calls from senators reflect a recognition that Democratic lawmakers may not be able to pass a transformative legislative agenda after under-performing in congressional races. And unless Democrats win two Georgia Senate runoffs on Jan. 5, Biden will be the first president since 1989 to enter office without his party controlling both chambers of Congress.

"The president-elect, beginning on January 20, should act as aggressively as possible to reverse the effects of the four years of Donald Trump, and to advance a more positive and effective agenda to make the United States the leader in fighting the climate crisis," Sen. Ed Markey, D-Mass., told NBC News.

He said Biden can re-enter the U.S. into the Paris climate accord and slap new fuel economy standards on vehicles and energy-efficiency requirements on appliances. Markey said Biden should "test the outer limits of his powers" through administrative action.

The push for executive action is also an attempt to nudge Senate Majority Leader Mitch McConnell, R-Ky., not to stonewall Biden's agenda, by dangling the prospect of going around Congress, as President Donald Trump often did with Republican support.

"I think President Biden has significant executive power. And anybody who doubts it? Look at his predecessor," said Sen. Ron Wyden, D-Ore.

How does the left reject Executive Orders?

They go to court over and over in districts that are friendly to their cause. We need to ask where they consistently get the money for these cases? Who are these lawyers? Do we only have a handful of patriotic lawyers in this land? And beyond that do we have the fortitude to fight back?

We need to use our own system to protect ourselves and to stall their agenda. We have failed to pay attention to how to make this system work for liberty. We sit and whine about how they use it to destroy liberty...well we’re not using one on the pillars of liberty. The legal system. Your very question, “How?” illuminates a hole in our defenses.

President Trump filled many of the courts with moderate to conservative judges over the last four years. There is a strategy in those moves and we need to learn to play 4D chess too. Sure, we’ll win some and lose some but the prize is at the midterms. This election isn’t a ‘last battle,’ it is a big one don’t misunderstand, but the judicial battlefield has been planted with a few landmines.

Trump has now appointed almost a quarter of all active federal judges in the United States. As of July 7, there were 792 active judges serving across the three main tiers of the federal court system: the Supreme Court, 13 regional appeals courts and 91 district courts governed by Article III of the U.S. Constitution. In his first term, Trump has appointed 194 of those judges, or 24% of the total. (This analysis excludes appointees to certain specialized courts, such as the U.S. Court of International Trade, as well as appointees to non-Article III territorial courts in Guam, the Northern Mariana Islands and the Virgin Islands.)

During his eight years in office, Barack Obama appointed the largest share of currently active federal judges, at 39%. Another two-term president, George W. Bush, appointed 21%. Around one-in-ten active judges (11%) were appointed by Bill Clinton, while much smaller shares were appointed by George H.W. Bush (2%) and Ronald Reagan (2%). One active federal judge, Carmen Consuelo Cerezo of the District of Puerto Rico, was appointed by Jimmy Carter.

Trump has appointed more federal appeals court judges to date than any recent president at the same point in their presidency.

Republicans should do what the Democrats did for 4 years.
Run to the courts every time Biden waves his pen and issues an executive order, and appeal them all right up to the SCOTUS if they don’t get a favorable ruling.

I keep waiting for breaking news that the federal marshals have arrested him. But the FBI would have to get right first. If Trump was found to do what biden has been doing for years he would have been arrested as soon as the laptop was found. I think we have the evidence needed and biden will never sniff the Oval Office as President.

I know this is over the head of some people here, but for others I’ll state the OBVIOUS:

IF Republicans can hold on to the Senate (yes, that includes RINOs), two things happen, both good - both possibly giving the country a chance to emerge from this horrific Democrat power grab without a civil war:

1) The federal courts DO NOT get packed. Meaning that Trump’s judges will have the power to stop Biden (Harris) power grabs at the Executive level (and yes, losers who can’t figure this out, this has happened in the past with conservative judges putting the brakes on Obama). Once the courts are packed, Biden will be able to do ANYTHING he wants, regardless of what Congress wants.

2) The FILIBUSTER remains in place, thus requiring 60 Votes for the upcoming gun grab attempts. And yes, even with the filibuster in place, they may still be able to pluck off 11 or 12 RINOs/semi-RINOs to pass some forms of gun control, but it will be FAR LESS DAMAGING than what they can do if they don’t need any Republican votes.

But I know, I know, so-and-so Republican is a RINO, so therefore I’m going to punish the GOP by letting the Democrats have the Senate (my kids and grandkids be damned).

[the above is EXACTLY what I had to deal with, on this site, leading up to the November election - thankfully they’re small in number...but, unfortunately, they are smaller in intelligence and they are still here - probably trying to come up with a way to discredit me]

Liberals have given the roadmap to tying Kamala’s administration’s hands when it comes to executive orders, especially on powers which are explicitly reserved for the executive. I can only hope that Republicans in the Senate extensively use the legal system to keep Kamala and Nancy’s reach around from being anything other than an exercise in frustration.

Don’t get me wrong, I LOVE MITCH - but I went through the Circuits before the election, and overall they were good for us - except the NE was terrible, something like 12-5 Dem for the circuit that covers PA. Certainly not Trump or Mitch’s fault...it’s just that Trump didn’t have the opportunity to flip that circuit.
