Diplomats can be arrested (i.e. taken into custody) until they can prove their immunity. It has happened many times, recently when a diplomat was arrested for shoplifting in a New York City department store.
As for the 14th amendment, here is an excerpt:

You can’t retro a law like that. And you can’t do it by executive order. Wish the press weren’t morons. Even if this is what he wanted to do, he simply couldn’t and the whole story is stupid.

In like manner: Laws are not important now, the ones that enforce them or choose not to or decide how they are to be enforced are.
