[Pennsylvania Election Code] Section 1223. What Ballots Shall Be Counted; Manner of Counting; Defective Ballots.--(a) No ballot which is so marked as to be capable of identification shall be counted. Any ballot that is marked in blue, black or blue-black ink, in fountain pen or ball point pen, or black lead pencil or indelible pencil, shall be valid and counted: Provided, That all markings on the ballot are made by the same pen or pencil. Any ballot marked by any other mark than an (X) or check (✓) in the spaces provided for that purpose shall be void and not counted: Provided, however, That no vote recorded thereon shall be declared void because a cross (X) or check (✓) mark thereon is irregular in form. Any erasure or mutilation in the vote in any office block shall render void the vote for any candidates in said block, but shall not invalidate the votes cast on the remainder of the ballot, if otherwise properly marked. Any ballot indicating a vote for any person whose name is not printed on the ballot, by writing or stamping, shall be counted as a vote for such person, if placed in the proper space or spaces provided for that purpose, whether or not an (X) or check (✓) is placed after the name of such person: Provided, however, That if such writing or stamping is placed over the name of a candidate printed on the ballot, it shall render the entire vote in said office block void. In districts in which paper ballots or ballot cards are electronically tabulated, stickers or labels may not be used to mark ballots. A vote cast by means of a sticker or label affixed to a ballot or ballot card shall be void and may not be counted. If an elector shall mark his ballot for more persons for any office than there are candidates to be voted for for such office, or if, for any reason, it may be impossible to determine his choice for any office, his ballot shall not be counted for such office, but the ballot shall be counted for all offices for which it is properly marked. Ballots not marked, or improperly or defectively marked, so that the whole ballot is void, shall be set aside and shall be preserved with the other ballots. I don't see anywhere in there where an election worker may alter or improve a mark on a ballot. That seems akin to a Florida 2000 election worker punching out a "dimpled chad." This would also seem to run afoul of the law concerning preservation of ballots:
Section 309. Preservation of Records.--All documents, papers and records in the office of the county board of elections of each county shall be preserved therein for a period of at least eleven (11) months, and all official ballots and the contents of ballot boxes shall be preserved therein for a period of at least four (4) months; in the event the county board has been notified in writing by the district attorney of the county, or by a judge of a court of record, to preserve said papers or contents of ballot boxes for a longer period of time, for the purposes of pending prosecution or litigation, said records shall be preserved accordingly.
An interesting explanation, but I don’t see anything in Pennsylvania law that would allow that. See post 41. At most, I could see doing this for an electronic double-check of a hand-count of the misprints, but the “misprints” need to be preserved and counted or rejected as the official ballot.

The video I saw was reportedly in Delaware County, PA. I haven’t seen the Wisconsin info. Wisconsin law does in fact seem to allow transcription of defective ballots. Wis. Stat. § 5.85(3). The original ballots must be preserved.
[It is not being corrected, if this is what they reported, the data is being transferred to a ballot that printed correctly. If they tried to scan the misprinted ballot things would be in the wrong positions, so it would not correctly register the vote or whom they had voted for, because the positional data would not be in the correct place.]
Ok, if this is in fact true, shouldn’t the misprinted ballots and the corrected/transferred ballots stay together afterwards to preserve the records as factual? Otherwise there can be no accurate record keeping.
