Illinois judge to rule on Rittenhouse extradition to Kenosha

An Illinois judge said he will decide late Friday afternoon whether a 17-year-old accused of killing two demonstrators in Kenosha, Wisconsin, should be extradited across the border to stand trial on homicide charges.

Defense lawyers had indicated before the hearing in Waukegan that they would call witnesses, including Kyle Rittenhouse’s mother, Wendy Rittenhouse, to try to block his extradition. But they called no one and said they had chosen instead to focus on legalities of the case.

After hearing 45 minutes of arguments, Judge Paul Novak said he would issue a ruling by 5 p.m.

Illinois declined to bring charges because Kyle didn’t bring the rifle into the state. The Wisconsin charges are still pending.

The Constitution requires states to return people accused of crimes in other states. It’s not up to Illinois judges to determine if Wisconsin law or prosecutors are just or not. If he rules against extradition, he will be overruled.

What made you think that? There was an announcement a few weeks back that Illinois was not going to charge Rittenhouse for possession of an AR, because there was no evidence that he possessed it in Illinois.

But the Wisconsin charges have never been even remotely considered for being dropped.

They were not “demonstrators”. They were violent rioters and killers who attacked Rittenhouse.

The only thing they were demonstrating was their contempt for law and life.

I hope during the past two months he’s put on weight and muscle tone because he’s going to have to defend himself if they put him in the general population in a jail in Wisconsin.

The facts of the case shouldn't matter. Illinois has him. Wisconsin wants him on murder charges. Constitutionally doesn't Illinois have no choice in the matter? They have to give him up?

I’m certainly no lawyer but it seems to me he should be able to get a writ of habeas corpus on the grounds that he should not be charged or held for what was pretty clearly an act of self defense.

The only thing at issue here, is that the Wisconsin case is so extraordinarily frivolous and vengeful - and on video.

Though if it is actually automatic, there would not be need for a hearing.
