A Michigan Court of Claims judge on Tuesday struck down Secretary of State Jocelyn Benson's directive that sought to ban the open carry of firearms at polling places on Election Day.
Judge Christopher Murray granted the pro-gun-rights groups who filed the lawsuit a preliminary injunction, effectively reversing Benson's October 16 order and eliminating a universal ban on the open carry of firearms at or within 100 feet of polling locations or absentee counting boards on Election Day.....
Murray wanted to narrowly define his argument, writing, "The Court's duty is not to act as an overseer of the Department of State, nor is it to impose its view on the wisdom of openly carrying firearms at polling places or other election locations," making clear that his "constitutional role is properly limited to only declaring what the law is, not what it should be."
Benson said in a statement that she will appeal the ruling.

Never felt the need to carry a firearm to a polling site. However, in light of BLM/Antifa threats... that has changed
You carry or you dont. Polling shouldnt have any bearing.
i carry everytime i vote
“Never felt the need to carry a firearm to a polling site.”
I rarely feel like going anywhere without a firearm.
I like this judge’s thinking. Could it be possible that we are finally turning a corner with the judiciary of this country?
certainly not open. But someone advised me that you cant carry concealed in a school there even with a carry permit but you can carry openly. Many, many polls there are in schools or churches with attached schools. Thus, open carry or no gun are the only options.
Agreed. I carry at the grocery store. I carry walking my dog. As I type this there are literally 3 different handguns within arm's reach. (all loaded, the one beside the keyboard with a round chambered) I carry everywhere I legally can.
Neither have I..not even concealed. But this year, for some reason, I will probably open carry. Not to showoff...but because under our constitution we are allowed to. Take THAT Big Wretch Gretch!!
And I will wear as much red as possible. It's time to show Lansing the distain I feel for them.
SOS can't just make up a law. Stupid people.
Sign that man up for a Federal Appeals Court Judgeship!
Be very careful, blu.
There is a federal law prohibiting carrying a firearm openly or concealed on school grounds unless you are licensed by the state in which you reside.
Michigan State law prohibits concealed carry permit holders from carrying concealed on school grounds. This does, however, allow ONLY CPL HOLDERS to carry openly on school grounds.
If you do not have a valid Michigan CPL, and your polling place is on school grounds, please do not open carry while voting.
I dont carry every minute ... mostly because cause I dont need to where I live
> I dont carry every minute ... mostly because cause I dont need to where I live
Until that one time that you do need it.
That read a little snarkier than I meant it.
Obviously it’s your decision to make.
