A judge has dismissed the third-degree murder charge against white cop Derek Chauvin over the killing of black man George Floyd after he knelt on his neck for almost nine minutes as he begged for air and said 'I can't breathe'.
Hennepin County District Judge Peter Cahill granted a motion to dismiss the charge against the former Minneapolis police officer in a ruling Thursday morning.
Cahill wrote in a 107-page court ruling that prosecutors did not have probable cause for the charge because there was no evidence Chauvin's actions were 'eminently dangerous' to anyone other than Floyd.

Will there be riots.....
So?
Any legal folks want to tell us if this is good, bad or matters in the big scheme?
thanks
That’s what I was wondering. Is it time for more rioting??? Since the response nowadays to liberals/radicals not getting their own way on something, is to start a riot and call it a peaceful protest????
This is actually bad for Chauvin. The prosecution might not have been able to prove beyond a reasonable doubt Chauvin committee 3rd degree murder. Now he will be charged with 2nd degree and a guilty verdict appears to be much more probable.
Of course there’ll be riots. They’ve been taking tattoo, hair dying and Starbucks breaks. But this’ll bring them back!
I guess the question is if MN law allows for lesser includeds to still apply.
Part of the over-reach...
Wasn’t that commie muzzlim AG handling this personally? And wasn’t he the one who elevated the charges after a short time? Looks like a fail for him.
So the Judge feels there is enough evidence, if it is assumed to be true, that allows for a trial on second degree murder or manslaughter. Wow. This is all going to boil down to the police manual on detaining people and the coroner’s report. I still think the officer has a good shot at acquittal as long as his lawyers no their stuff.
Does anyone know for certain: Applying knee pressure on a non-compliant suspect’s neck (as Chauvin did), without blocking air or blood flow — was a restraint tactic taught by the Minneapolis Police Department (and PDs as well).
Ive seen conflicting reports on this.
“Of course therell be riots. “

Yes. Rioters don’t actually ‘need’ a reason to riot.
no = know
He did it by the book.
The murder charge doesn’t matter. Nobody will be found guilty of murder because Floyd died of a fentanyl overdose.
Really? I thought the coroner had placed the cause of death as a fentanyl overdose. How could somebody be convicted of murder when the victim died from a drug overdose?
3rd degree murder (not intentional) is the only charge he can possibly be convicted on. So bottom line is he won’t be convicted of anything. Won’t be tried for anything. My opinion.
Wont second-degree be harder to prove?
Floyd died of a drug overdose and his stupidity.
