You’re right and wrong. Sure it’s a crime to delete them but if those emails contain classified information the release of which is harmful to out interests then that would add to the crime already committed.

Okay, you go ahead and get yourself into a criminal investigation and you tamper with evidence. I particularly want you to tamper with evidence that wouldn’t have otherwise incriminated you, but for the sake of the experiment make sure they know you destroyed the potential evidence anyway. See what happens.

Why can’t she still be charged with tampering with evidence? and if the emails discovered contain classified documents why couldn’t she be charged with obstruction as well?
