7th Circuit stays district court injunction allowing Wisconsin ballots postmarked by Election Day to be counted if received up to 6 days later. No list or count of judges backing the order. No rationale given.

fta: “No rational given” - how about because the constitution says the legislature determines the details of elections, and the court is trying to usurp the state legislature’s authority? Or because the court was trying to make law instead of apply the law?

What is all the fuss? Everyone knows when election day is, same as April 15. Just mail it in time to get it postmarked on time, not a problem.
Back in the Gore/Bush contest in Fla, the U.S. Supreme Ct ruled 7-2 that State Law took precedence as far as vote counting and deadlines. I expect a lot of the rulings by courts extending deadlines to be overturned before the election.

Was ACB part of the panel that granted the stay?
The date for presidential elections is set by the US constitution. Article 2 Section 1 provides that the state legislature directs how presidential electors are appointed by that state - the state legislature not the courts. The courts may not write the rules for selection of presidential electors

The rats did an end around with this one. The WI SC is still 5-4 Conservative so they bypassed them and found a sympathetic Rat fed judge who would allow them to cheat.
Can someone net out what this ultimately means? Will WI now be able to “count” votes received up to 6 days after election day or not as a result of the 7th Circuit ruling?

And it's surely not possible to postmark 11-3 on a ballot on the 4th ... or 5th ... or 6th ...
The PA 3rd circut Court is 13 to 9 GOP.
In my neck of the woods the would be three weeks late.

I believe the problem is that the ballots are already pre post marked, so everyone can keep voting after the election.
Nauseating. I want to vote in person early and then fly out to some hole in Siberia for the rest of Election Day. Which apparently may last a decade.
