Judge opinions almost always state the argument of the side they are in opposition with in very strong terms followed by a BUT and then proceed to dismantle that argument. This is how judges give their opinions.
Obviously they did refuse him....some senators were up for re-election.(they just didn’t want to go through hearings and a negative vote). So Mc Connell scuttled the vote.
