Before current Justice Breyer was on the SC he was a federal circuit court judge. Jimmy Carter nominated him to the federal circuit court of appeals AFTER he had lost the election. The lame duck Dem senate (which had also lost their majority in the election) confirmed him in December. There’s plenty of precedent to replace Ginsburg now.
