Ted Cruz urges Senate to fill Ruth Bader Ginsburg’s seat, warning of ‘constitutional crisis’ on Election Day

Sen. Ted Cruz on Friday urged his fellow lawmakers to nominate and confirm a Supreme Court justice before the Nov. 3 presidential election following the death of Ruth Bader Ginsburg, warning of a looming “constitutional crisis” if the seat remains vacant.

“We cannot have Election Day come and go with a four-four court,” Cruz said during an interview with Fox News’ Sean Hannity. “A four-four court that is equally divided cannot decide anything. And I think we risk a constitutional crisis if we do not have a nine-justice Supreme Court, particularly when there is such a risk of a contested election.”

The Texas Republican — one of President Trump’s 20 potential nominees to the court, according to a list issued last week by the White House — called on Trump to nominate Ginsburg’s successor next week. Ginsburg died Friday due to complications of metastatic pancreatic cancer. She was 87.

“I think it is critical that the Senate takes up and confirms that successor before Election Day,” he said. “There’s going to be enormous pressure from the media, there’s going to be enormous pressure from the Democrats to delay filling this vacancy. But this election, this nomination is why Donald Trump was elected. This confirmation is why the voters voted for a Republican majority in the Senate.”

Cruz continued: “I’ll tell you one reason in particular why I think it is tremendously important that not only does the nomination happen next week, but that the confirmation happen before Election Day. Democrats and Joe Biden have made clear they intend to challenge this election. They intend to fight the legitimacy of this election. As you know, Hillary Clinton has told Joe Biden ‘under no circumstances should you concede. You should challenge this election.'”

Cruz would be an excellent Supreme Court Justice, but he wishes to pursue a political career....and he may well be president some day. Trump should pick somebody off of his list (Coney-Barrett?) quickly and the Turtle should ram that nominee through and get them seated. This needs to happen lightning fast no matter how much the MSM/Democrats scream about it.....rest assured, they will.

Not counting the unreliable Roberts, constitutionalists would only outnumber them by one - if Trump fills the vacancy.

I think the ‘crisis’ end of this occurs around the end of November when Michigan and Pennsylvania say they can’t certify the election because everything is so screwed up, and can’t meet the 14 December deadline for the EC.

There are two possible Constitutional outcomes here that don't involve the courts:

  1. The state legislatures step in and asserts its Article II Section 1 power and selects the Electors directly.
  2. The states fail to appoint Electors and they don't participate in the Electoral College. The 12th amendment says that a majority of "appointed" electors is needed to win the Presidency. Pennsylvania's 20 Electors and Michigan's 16 Electors will be un-appointed, lowering the majority to win from 270 to 252.

There is nothing for a court to do. The Electors will either be there or not; the Electoral College will Constitutionally function with or without them.

There will most likely be a Constitutonal crisis about the election and the court has four Leftists: Breyer,’wise latina’Sotomayor,Kagan and Roberts.

In this case, various angry groups are going to sue up and down the line of the two states, and the Supreme Court will end up with the crisis. All of this is designed to go into January and have the House/Senate do their assigned duties of selecting the ‘winner’.

With a 4-4 court, all lower court decisions hold.

These law-breaking decisions from the Pennsylvania and Michigan Supreme courts regarding no post mark on ballots and counting votes after election day will stand if RGB has not been replaced.
