Ted Cruz urges Senate to fill Ruth Bader Ginsburg’s seat, warning of ‘constitutional crisis’ on Election Day

Sen. Ted Cruz on Friday urged his fellow lawmakers to nominate and confirm a Supreme Court justice before the Nov. 3 presidential election following the death of Ruth Bader Ginsburg, warning of a looming “constitutional crisis” if the seat remains vacant.

“We cannot have Election Day come and go with a four-four court,” Cruz said during an interview with Fox News’ Sean Hannity. “A four-four court that is equally divided cannot decide anything. And I think we risk a constitutional crisis if we do not have a nine-justice Supreme Court, particularly when there is such a risk of a contested election.”

The Texas Republican — one of President Trump’s 20 potential nominees to the court, according to a list issued last week by the White House — called on Trump to nominate Ginsburg’s successor next week. Ginsburg died Friday due to complications of metastatic pancreatic cancer. She was 87.

“I think it is critical that the Senate takes up and confirms that successor before Election Day,” he said. “There’s going to be enormous pressure from the media, there’s going to be enormous pressure from the Democrats to delay filling this vacancy. But this election, this nomination is why Donald Trump was elected. This confirmation is why the voters voted for a Republican majority in the Senate.”

Cruz continued: “I’ll tell you one reason in particular why I think it is tremendously important that not only does the nomination happen next week, but that the confirmation happen before Election Day. Democrats and Joe Biden have made clear they intend to challenge this election. They intend to fight the legitimacy of this election. As you know, Hillary Clinton has told Joe Biden ‘under no circumstances should you concede. You should challenge this election.'”

the R’s better not be accommodating to a party who has domestic terrorists as their base. no more GOapPeasment.

And after Kavanaugh, we need to assume the Democrats will not act in good faith. There's actually no need for hearings. Fill the seat.

cruz is a winning ticket on legal training, legal heavyweight lifting, nomination process, respect and concern for the election process, and 2A / strict constructionism.

we don’t need another ‘bouncing betty” in the USSC right now.

I think ‘out of respect for the position as a Supreme Justice’, and the court itself people are comfortable saying RIP.

Kinda like when people, out of courtesy, greet you with..’How are you” but they really don't want to hear how bad things might be. It's just a greeting. RIP is rather like saying...BYE!

It would be so great if Cruz would reconsider. Yet I understand wanting to stay in the fight arena. Still he'd be as close to perfect for the position one could be. Fair saying he was raised teething on the Constitution! and often said "he's a walking Constitution."

im not sure new jersey will be counted, since every person voting in person has to do provisional, then they have to check each vote against the absentee list.

Sec. 204.001. APPLICABILITY OF SUBCHAPTER. This subchapter applies to the office of United States senator.

Acts 1985, 69th Leg., ch. 211, Sec. 1, eff. Jan. 1, 1986.

Sec. 204.002. TEMPORARY APPOINTMENT TO FILL VACANCY. The governor shall appoint a person to fill a vacancy in office if the vacancy exists or will exist when congress is in session. The appointee serves until a successor has been elected and has qualified.

if cruz is nominated and democrats vote en bloc against cruz or even approaching that, then imho that should be a good litmus to us all as to how close we are to civil war ii.

So brilliant that she consistently ruled against the sacred lives of aborted babies for so many years. There's a special place in hell for this "brilliant" jurist. May the good Lord deal with her with as much "brilliance" as she had for those millions of unborn children.
