A federal appeals court ruled late Monday that the Trump administration may deport hundreds of thousands of illegal alienswho previously received temporary protected status for "humanitarian" reasons, in some cases decades past the event that spurred the temporary reprieves.
The 2-1 ruling by a panel of the U.S. 9th Circuit Court of Appeals overturned an injunction protecting aliens from El Salvador, Haiti, Nicaragua and Sudan from being deported pending litigation.
The Trump administration ended their protections, saying their home countries were now safe for them.
The decision affects 300,000 non-citizens here illegally -- and a staggering 200,000 of their children who were born here during the "temporary" protection, and are considered U.S. citizens.
Many have lived in the U.S. for decades, as administrations of both parties have kicked the can down the road with repeated extensions -- until President Trump acted to stop it.
Judge Consuelo M. Callahan, writing for the majority, said federal law does not permit the judiciary to second-guess decisions by the secretary of Homeland Security on which countries' citizens receive protected status.
"To the extent the TPS statute places constraints on the Secretarys discretion, it does so in favor of limiting unwarranted designations or extensions of TPS," wrote Callahan, an appointee of President George W. Bush. She was joined by Judge Ryan D. Nelson, an appointee of President Trump.
Judge Morgan Christen, an appointee of President Obama, dissented.
She said the Trump administration had changed policy and practice without public review. She described the administration's action as "an abrupt and unexplained change."
She noted that the lawsuit challenging the deportation notices said they were motivated by racial and ethnic bias, an assertion presented without evidence.

At some point, the Court will have to review the 14th Amendment.

Meh, its a 2-1 ruling. The En Banc that is almost certainly coming will reverse this.
I have very mixed feelings about it - and it is certainly not right for people to come here specifically so that their children become ‘anchor babies’.
You are correct that the Amendment was never intended to be used in the way it has been by many foreign nationals.
It’s long overdue that the Supremes address this - but perhaps the moment is becoming more ‘ripe’.
