The California Supreme Court on Monday overturned the death penalty sentence for Scott Peterson, convicted in the Christmas Eve murder of his pregnant wife, Laci, and their unborn son, Conner.

The court's decision came over 15 years after Laci, a Modesto, Calif., school teacher, was killed. Investigators said Peterson dumped his wife's body from his fishing boat into the San Francisco Bay in 2002. The bodies surfaced months later.

While the murder conviction against Peterson stayed in place, the court ordered a new penalty phase trial.

To be clear, Peterson is not a “weirdo” ... he’s a convicted multiple-murderer. I think it is not only a travesty of justice that he is not executed, it is immoral that he be allowed to keep his life after murdering his innocent wife and unborn son.

I would say he is guilty, but since it was circumstantial I would have given him life. California spends a fortune on death row inmates and never executes them anyway.

“and he probably should get a new trial”

He was guilty. Everybody KNEW he was guilty.

However, the state, in no way proved that in court.

The only question remaining is, where does justice lay?

I think a new trial may be warranted. And I think the risk of him going free is worth the preservation of legal process.

But it will never, ever happen.

Because everyone knows he is guilty.

Scot Peterson, the former sheriff’s deputy and school resource officer who was on duty during last year’s Marjory Stoneman Douglas High School shooting in Parkland, Florida, was arrested Tuesday for his alleged failure to take action during the shooting.

Peterson, who has been referred to as the “Coward of Broward,” heard the gunshots after Nikolas Cruz opened fire on his Parkland classmates and teachers, killing 17 people in the process.

I'm curious. Has anybody on death row in kalifornia actually been executed in, say, the past 20 years?

Because, this guy is still alive 15 years after he was sentenced.

Don’t know about California but in many states if on death row you are isolated from GP. Now that he is off, maybe someone will see to it he gets justice.

Nancy Grace is going to flip her frosted wig when she hears about this.

..and her nostrils are going to flare.

OK, to be clear, his conviction was affirmed. Only his sentence was thrown out and remanded for a new penalty phase hearing.

It took me a while but after much reading I understand what you state above to be true.

Sort of

So they asked some jury members if they could give Peterson the death penalty, if they even believed in the death penalty. A couple said they didn't believe in the death penalty but could assign it if need be.

Evidently those that who stated they didn't believe in the death penalty were not allowed to vote in the penalty phase?

Seems like a bunch of nothingness to me but the fine man Scott Peterson ain't getting out of jail but he might get to live until he dies naturally.

Lord I remember this case so well. What a horrid man he is.

I didn’t see any good evidence mentioned by the media. A hair from the wife in his boat wasn’t enough, because her hair was probably in the boat before she died anyway. He ran, so it looked like he was trying to hide something. ...or simply knew that he was going to be lynched.

The media and crazy judicial folks in California messed up the case with their hysteria.

Did see the Fox girls ranting and raving for days about their feelings that he was guilty, though. Sounded like they were trying to incite a lynch mob. With so much other garbage coming through satellite TV, I cancelled the account. Haven’t watched TV since then.

Since it was all Greta VanSustern of FOX talked about for two years it’s hard to forget. Every friggen night, Scott Peterson and Natalie Holloway.

There is a video series that runs on Discovery networks about this case. It is very interesting and even handed. When the court case was going on I follow some of it because I wanted justice for the dead. Lot’s of Nancy Grace because she seemed to be dialed into what had happened. After viewing the series as recently as early this year I have a reasonable doubt that Scott didn’t kill them. The timeline(as described by witnesses) and the other persons that were in the area cast doubt. Is he a scum bag? Absolutely. Double murderer? Not convinced.

BTW Mrs. Mad watched the series with me and is more convinced than she was previously that Scott did it.

Now that the California Supreme Court has vacated Peterson’s death sentence, he will be placed into the general population where the California Supremest Court, that is, the inmate court in California prisons, just might overrule the California Supreme Court. Wife and baby killers often check out in a pine box before the end of their sentences.
