Contested Flynn dismissal to go before full appeals court as legal saga drags on (En Banc hearing granted!)

The dispute over the Department of Justice's move to dismiss criminal charges against former Trump national security adviser Michael Flynn will get a rehearing by the entire District of Columbia Circuit Court of Appeals, the latest twist in the long-running legal drama that stemmed from the FBI's investigation into possible collusion between the Trump campaign and Russia in 2016.

The order was issued Thursday by the court. Called an "en banc" hearing, all 11 judges on the appeals court will sit in on a rehash of arguments that were made before a three-judge panel in June, which led to a 2-1 ruling in favor of Flynn.

The DC Circuit is majority political hacks. Everything in DC is majority DEM/left/marxist conclusions in strained constitutional rhetoric.

That it is even entertaining this, en banc, is a stain. Regardless of the outcome. The court is knowingly using punishment by process. It knows Sullivan is out of line, it knows Flynn should have been out from under the government frameup since end of May, but now two courts, Sullivan and the DC Circuit think it better to hold up.

No matter how it decides, the loser will be petitioning to SCOTUS. It knew this going in too, and is doing what it can to inflict maximum delay in resolution.

Punishment by process.

President Trump should not pardon Flynn at this point when Flynn is still trying to be exonerated. Only if Trump loses should he issue a pardon to Flynn.

So in the meantime, Flynn continues to pay attorney fees and be abused by the federal courts. Let President Trump exonerate him now, instead of hoping for it from the black-robed thugs.

I'm not sure POTUS can pardon a court-initiated criminal contempt. Separation of powers. Each branch has some inherent power (Congress can jail for contempt, courts can jail for contempt) that other branches can't step on. POTUS pardon power is for CRIMES, and despite it's misleading name, criminal contempt is not a crime.

At this stage, I fear there will be no justice through the judtice system, nor will there be a remotely honest election November 3. In 2016, the Left lost because of over confidence. This time they will use every fraud and violence necessary to assure the official numbers come out the way they want. It is going to take more than the ballot box to save America.

I don’t either. AG Barr allowed Mueller’s Democrat lawfare thugs to assault Flynn for over 400 days. He could be inflicting massive pain on them right now for their criminality. He is not. That’s all you need to know about “justice” in the Barr DOJ.

What exactly is the 90 day Rule?

They don't bring charges or announce any investigation into the politicians 90 days before the general election.

Nice thought, but it would have never gotten through the Senate. It needs a lot more republicans since many side with the establishment. Even 60 isn’t enough because of the filibuster, so there needs to be a super majority just to get to 60 to pass any legislation favorable to the Trump side.

The left has only one play. It is obstruct, obstruct, obstruct. For them it is just like the election when they keep counting votes. The days go by until one day all is in their favor. They do it with the dismissal of US atorneys, General Flynn, Roberts- process decisions, and executive orders. Contest, obfuscate, obstruct.

Most all are predicting Flynn will lose, which means it goes back to Sullivan who will then hear actual arguments. When the election is over, Trump can pardon him to end this ridiculous persecution.

Judge Sullivan was made a respondent to the mandamus petition by Flynn.

He requested the en banc review.
