Why do I think they can’t do this?

The constitutionality of this has not been tested yet, however, if a person is diagnosed with the Wuhan virus and her doctor tells her that he can’t prescribe HCQ + zinc and the anti-biotic then she could file a lawsuit and an emergency injunction against enforcement of the rule/law in question. since it is a suit by one individual, not a class, an emergency injunction might very well be successful.

I think a Federal judge would find that the individual has a “right to try”, (isn’t that the name of a federal law?), the state has no right to risk her life for their “theory” that the medical regimen is unsafe since there is no definitive study on this drug.
