Assistant Circuit Attorney Chris Hinckley ordered crime lab staff members to field strip the handgun and found it had been assembled incorrectly. Specifically, the firing pin spring was put in front of the firing pin, which was backward, and made the gun incapable of firing."
How the heck does this happen?! Is it a manufacturing error, or did a previous (incompetent) owner tinker with it? Very odd. And no, nothing will happen to Kim Gardner because she's an Affirmative Action hire, one of many helped into office by Sörös and Co. The incompetent negress Kim Foxx is doing the very same thing in Illinois.

Malicious prosecution under color of authority.

The homeowners are attorneys who ‘broke’ the gun in order to allow it as evidence in another court case. So they knew it was inoperable at the time of the incident. State law prevents prosecution if weapon is not operable.

Loss of BAR license should be automatic. As well as ability to serve in any public office of trust.

McCloskey's used that gun "as a prop in a lawsuit against gun manufacturers...."

There are no winners or friends on either side of this one.

The McKloskey’s had intentionally made the gun inoperable so that it could be brought into a court room in a previous case. They knew it was inoperable at the time it was brandished.........The DA’s office is a travesty of justice. Gardner should be disbarred permanently...............

We don't know that.

If I rob a bank with a handgun and get arrested 3 days later they won't drop the armed robbery charge just because the firing pin spring has been reversed.

Think about it. If all a criminal has to do is disable his gun after the crime to avoid gun charges crime would be a piece of cake.

From another thread, the pistol had been used in a previous court case by the lawyers under charges and had been deliberately made inoperative to bring it into the courtroom.

They apparently had not corrected the problem with the gun.

I think you are missing a vital piece of info. That which they are charged with requires the firearm to be operable. If they had robbed a bank the condition of the firearm would be irrelevant.

Why haven’t they been arrested yet, Why does our side always wait to long to do anything?

It would be relevant for armed robbery if the law required a working weapon.

My point is if any crime requires a working weapon and the gun recovered days later just has a spring reversed I don't think it's reasonable to let the perp off.

Who would grab a non-functioning firearm? No wonder she casually flags her husband several times — they both knew it was only a prop. Did the rent-a-mob know?

This fact is making me think the entire episode is lawfare to impinge on everyone’s self-defense rights.

Tampering with evidence? Seems like I remember that once being illegal.

It seems that the only people who are being charged with crimes are law-abiding citizens. Upside down, backwards and sideways.

This is right out of the film “Shooter” where Wahlberg’s character swapped firing pins among his weapons, rendering them all, including the “murder weapon” inoperable.

“Perpetrating a fraud on the court”

So the Judge could throw her in the slammer for contempt and sanction the prosecution by dismissing the case.
