Federal appeals court rules Trump admin can't withhold federal grants from California sanctuary cities

A federal appeals court ruled Monday that the Trump administration cannot withhold federal grants from California sanctuary cities, affirming previous rulings in the state.

The U.S. Court of Appeals in San Francisco said its ruling that the Justice Department cannot block police funds from cities not enforcing immigration laws does not extend nationally, Bloomberg News reported.

The decision follows rulings from three other regional federal appeals courts against the administration. But a New York court unanimously ruled in February that the department had the authority to withhold funds from the cities that do not comply with federal authorities' enforcement of immigration laws.

The 2nd Circuit Court of Appeals declined to reconsider its February ruling on Monday.

Bloomberg noted that the conflicting decisions make it more likely for the Supreme Court to eventually take up the case.

But the Supreme Court declined a request by the administration to review sanctuary laws in California cities last month. The denial allowed lower California court rulings against the administration to stand.

It already is a federal crime. In fact if you harbor an Illegal alien who kills someone then the penalty for you can be death. Section 8 immigration law.

Okay, then Pres. Trump should ignore that ruling and do as he likes, just like Obambi. Let the court send US Marshals to arrest Trump. The dem/soc/coms will finally get the war they are itching for. I'm tired of this shit. I'll take point for those behind me. Just let me know where to meet in my area.

The Scotus ruled that ONLY FedGov can enforce immigration law in US vs Arizona SB 1070.
Sanctuary cities flout that ruling.
Therefore government can respond with fiscal or other reductions to entice compliance on the law...

I agree, but the money allocated by the DOJ is a grant. So if the President as the Chief law enforcement officer just ends the grant then the States and municipalities still get nothing. Smaller cities will suffer but so be it.

This reminds me of the 55mph limit and federal transportation funding discussion from the 1980’s. Iforget how that one came out. Not exactly the same as not a fed law for speed limits.

This is what I don’t like about Trump. He could have just kept quiet and awarded the grants to other cities. Let them wonder for a year why they are not getting it. Insist you are looking into it but just delay it.

The Federal Government has every right to expect the states to obey federal law. If they don’t want to, let them do without federal dollars.

Only in areas where the Federal government out to be, and only when in conflict with the State. Tell me, where does the Constitution say FedGov can spend $$ on free grants to local cops? At all?
