Judge Emmet Sullivan filed an appeal Thursday of the 2-1 writ of mandamus ruling last month by the U.S. Court of Appeals for the District of Columbia to dismiss the Justice Department case against former Trump National Security Advisor Lt. Gen. Michael Flynn (US Army Ret.) Sullivan is asking for an en banc hearing by the entire eleven judges on the appeals court.
The main argument by Sullivan and Wilkinson seems to be, “Get off my yard!”:
“The panel’s decision threatens to turn ordinary judicial process upside down. It is the district court’s job to consider and rule on pending motions, even ones that seem straightforward. This Court, if called upon, reviews those decisions—it does not preempt them.

Judge is holdinng up the process because obviously there is something that is going to happen when charges against Gen Flynn have ceased.
Here is what Flynn’s lawyer said days ago, and now Trump’s lawyers says it: Trump attorney and campaign legal advisor Jenna Ellis says Sullivan has no standing to appeal, “Not surprising but totally ridiculous. Sullivan is NOT a party. He actually has no standing to petition for en banc. He should be removed from the bench entirely after his egregious conduct.”
Remember Judge Emmett Sullivan no longer has an accuser. How can he conduct a trial without an accuser? He is a democrat and is trying to keep this going, trying to influence the November 2020 election. That is his only reason for trying to hang on. He is a slimeball!

This is one of the most disturbing and ridiculous things I have ever seen. A judge appealing an appeal to his own ruling? He should have zero standing to do so.

Sullivan was nominated to the U.S. District Court for the District of Columbia in 1994 by former President Bill Clinton. He was confirmed later that year.
Prior to that, Sullivan was nominated to the District of Columbia Court of Appeals in 1992 by former President George H.W. Bush. In 1984, he was nominated to the Superior Court of the District of Columbia by former President Ronald Reagan.
