James Ho and Don Willett (47 and 53) on the 5th Circuit would both be good picks, but I’m not sure we have the votes in the Senate to confirm them this year. They were both barely confirmed to the 5th Circuit, and there will just be too much temptation for Romney and a couple other “moderates” to grandstand and allow a filibuster.
