What they did, brandishing, is illegal in a lot of places (dont know about MO), and you can bet, if it is where they live, theyre both going to prison.
No such thing as brandishing in Pennsylvania, don’t know about Missouri.
But there are plenty of other laws our creative Police/DA could use.
So in those states with brandishing laws I presume the police never point their firearms at someone without shooting them. Really?
"State law allows a person with a valid concealed carry permit or endorsement, lawfully carrying a firearm in a concealed manner, to briefly and openly display the firearm to the ordinary sight of another person, but the permittee is prohibited from intentionally displaying the gun in an angry or threatening manner that is not in necessary self-defense. Mo. Rev. Stat. § 571.037."
It seems like the question is whether or not their display of firearms was "in necessary self defense". Based on what has happened around the country in the last few weeks it seems like a tough case for the prosecutors to make.
