Finally, a semblance of sanity has been restored to the law and Constitution in the misbegotten prosecution of former National Security Adviser Michael Flynn.
The U.S. Court of Appeals for the District of Columbia Circuit on Wednesday ordered the controversial lower court judge, Emmet Sullivan, to follow the law by dismissing the false statements case wrongfully brought by the original federal prosecutors who were either incompetent or corrupt — maybe both.
As evidence emerged that Gen. Flynn was set up and framed by malevolent actors at the FBI —fired Director James Comey, fired Assistant Director Andrew McCabe and fired counterintelligence agent Peter Strzok — the Department of Justice (DOJ) moved to dismiss charges against Flynn a month ago.
If the retired three-star general can be faulted for anything, he is guilty of being human. Under threats and duress (as well as bad advice from his prior conflicted counsel), Flynn pleaded guilty.
He caved in to the tactics of intimidation, coercion and bullying. He should never have done so. Flynn began to regret it, as evidence of his innocence materialized. He then sought to withdraw his plea. He had the absolute right to do so under the law.
Judge Sullivan inexplicably balked. This precipitated a skilled legal effort by Flynn’s new and better attorney, Sidney Powell, to uncover the exculpatory evidence proving that her client should never have been charged with anything at all.
Notes concealed by the FBI and prosecutors showed that Flynn did not lie to bureau agents. Instead, he was the victim of a politicized campaign by Comey, McCabe and Strzok to falsely accuse and wrongfully convict him of a crime he never committed. The bureau never had a legitimate reason to even interview Flynn because he had done nothing wrong and the FBI well knew it.

I doubt Sullivan is calling the shots. He’s a puppet of deep State, Obama maybe worse. He’s going to be destroyed hanging on to this case for the bad actors who need to drag this on past the election.

As a true professional I assume Jarrett is giving this corrupt “judge” the benefit of the doubt. Sullivan knew EXACTLY what he was doing. And I think we all know for whom he was doing it.

What people need to understand is that the federal judiciary is full of Judge Sullivans. They do not care what the law is or what the legislature passed. They are going to do whatever they want regardless of legal principles (oxymoron) and the left will stand up and cheer.
Since the Court of Supreme Whim has already ruled on something similar that implies this case can be held in limbo until it gets to that corrupted court as well. It should be over but it’s not.
Flynn was targeted by Obama and Obama personally. That is clear. Obama didn’t like Flynn for many reasons but he also had reason to fear him politically. Their is plenty of motives to place at Obama’s feet. This also shows that the FBI was working to carry out Obama’s personal vendetta, which shows absolute and horrid abuse of presidential power. The FBI, being charged with carrying out justice should have refused to do Obama’s bidding when it crossed the line into illegality. They didn’t, they gladly excepted the task of taking out Flynn to benefit Obama and the democrats.
Heads should roll here and the swamp should be turned upside down in order to get to the bottom of this travesty and illegal operation. All the dots are sitting there ready to be connected, but sadly, Barr has already stated that Obama will not be investigated in any way shape or form.
This is 3rd world banana republic stuff and should never be tolerated in American politics and it illustrates how our elites are giving the American people the shaft.
Now that Uncle Ben’s Converter Rice is no more, maybe we can rebrand it as Uncle Emmet’s Convicted Rice and show a picture of him and Susan Rice on the box.

“Leave of court” is for the benefit of the defendant and nobody else. That was the basis of today’s ruling.

Definitely yes. Even a cursory study of the underlying charges show that they were pitifully constructed and based in nothing at all. The former Obama regime was out to get General Flynn on a personal basis, and pulled out all the stops to pull him down in a personal vendetta, on the way to their main objective - to discredit the incoming Team Trump in any way, shape, form or manner possible, law be damned.
The Hydra raises its many heads, and even if one or more are chopped off, it still keeps attacking.
You know the shrug Jerry Nadler gave to Candace Owens after she gave him a reproof? The intel agencies will give that same shrug when Flynn is cut loose and they ID the corrupt players.

No. The next step will likely be to seek an en banc ruling of the full circuit.
I fully expect the Judge to try another trick, he has no choice, HE TOOK THE BRIBE MONEY!!!, he can’t just give it back.
