A federal appeals court on Wednesday ordered a judge to grant the Department of Justice's (DOJ) unusual move to drop charges against former national security adviser Michael Flynn.
A three-judge panel on the D.C. Circuit Court of Appeals approved Flynn's petition to intervene in the case after a district court judge had tapped an outside counsel to argue against the DOJ's move.

The Obama appointee (Wilkins) voted against it on procedural grounds. He said that Sullivan deserved his chance to “explore” the issues.
The whole point of the charade at this point is to delay justice, drive Flynn further into debt, and (IMHO) especially to keep him gagged so he can’t reveal anything about Obama’s Muslim-backing machinations during the 4 months between now and Election Day.

I would venture better than even odds that Sullivan will try to drag this out by some other means.

If the D.C. Circuit Court of Appeals had ruled for the judge, who would have argued the continuing case? Would Judge Sullivan have formed a new, separate DOJ by hiring a staff of lawyers and investigators to carry on the prosecution of Flynn?

When does this take place? Does Flynn have to wait until Sullivan appeals the order? Too many side issues with this case. Van Grack and Weisman should be in prison and financially drained.
