ALBUQUERQUE, N.M. The law firm representing the man who was shot during a protest against the statue of Spanish conquistador Juan de Oñate in Old Town on Monday night has sent a letter to city and county agencies announcing its intention to file suit on his behalf and asking that evidence be preserved.
The tort claims notice was sent to the city and the Albuquerque Police Department and includes the possible claims of negligence resulting in battery; conspiracy to violate civil rights, violations of the rights to equal protection, substantive due process, and right to peacefully assemble; denial of access to the court; defamation and slander. The Bernalillo County Clerk and the Bernalillo County Risk Management also received the letter.
Spokespeople for APD and the city did not immediately respond to comment Friday evening.
In the letter, attorney Laura Schauer Ives recounted the events at the protest that led to her client, Scott Williams, being shot. She said Baca had careened into many protesters and inexplicably and distinctly battered three women, throwing one of them to the ground, leading the crowd to turn on him.
Two people chased after Baca and he pulled out a gun and pepper spray, according to the letter. Thats when Williams, 39, intervened and picked up a skateboard to hit the gun out of [shooter Steven] Bacas hands. Williams was shot multiple times.
Schauer Ives said her client was holding a vape pen, not a knife as some have alleged on social media.

Williams is seen in the numerous videos hitting Baca with the skateboard, first after the woman protester went to ground after blocking Baca, then chasing him down the street with another Antifa, both dressed all in black with full face mask, and the one shot with the skateboard, the weapon of choice for Antifa. About the only thing in the letter that is correct is that the police cowered behind the ABQ Museum at the direction of the Dem mayor and ignored calls for assistance until shots were actually fired.
And how is this the fault of the city and county?
I strongly suspect this was wargamed beforehand, for such an eventuality.

The APD was perfectly willing to allow Baca to be beaten to death, until he defended himself.
The woundee needs to make up it’s mind. You want the popo or you don’t want the popo. Bet he never ‘boarded’ at Kistler Collister. Or the I-25 to I-40 west bound ramps. Some may know, some may not. :-)

Wow, this really puts the city in a quandary. Either have to admit fault (for whatever) OR defend the shooter defending himself. Liberals eating themselves. And realistically, if the lawyer thug who got shot thought they had a good case, they would be suing the shooter. They know the city will settle rather than defend the shooter.

The only tragedy in this case is that Scott Williams survived.
So true, even if not directly uttered by the skateboard attacker, the fact that others attacking Baca were shouting it is enough to fear for your life and shoot. Like that man in Dallas that was beaten to death (or nearly so, I never heard the final outcome), if you are caught by the Antifa mob you will be severely injured or dead, one of the two.

And somehow this is the city's fault? I suspect the suspect in the assault hired a shady law firm, or one with connections to some gray-area types. They probably found out the guy he assaulted, who subsequently shot him, doesn't have much/any insurance or possessions. So it is potentially far more lucrative to go after the city with it's deeper pockets.
After all, it's all about the money. Something bad happened to that {censored}, he got shot. Someone has to pay! Because we all know liberal snowflakes never take responsibility for the consequences of their own actions. He probably thinks he should be able to pummel Trump supporters, heck anyone who disagrees with him, with his skateboard at will. There shouldn't be any consequences to his actions, after all, he's sure he's in the right... ;-/
It is people like this idiot with the skateboard that got shot that make me think maybe making birth control free and widely available is a good idea. I wish his parents had had access to some.
And BTW throw into the mix that the District Attorney is one of the Soros-elected DA's, who is intent in keeping Baca in jail even though the shooting charge has been dropped (for now, he says). See the link I posted below for all the dirty details.

He first had a skateboard he hit Baca with, and that kind of slipped out of his hand and another person grabbed it and then he had what looked like makeshift knives or shivs in his hands.
That, and he’s damn near 40 years old out dressed like a teenager trying to tear down statue.
