Boris Johnson 'will tell the EU that Britain will choose a no-deal Brexit if trade talks stall'

Boris Johnson will warn the EU today Britain will choose a no-deal Brexit if a trade agreement is not struck by the end of next month.

The threat comes despite the head of the World Trade Organization suggesting that doing so could slow the UK’s economic recovery from coronavirus, and that a deal similar to current arrangements would be better for jobs.

WTO director-general Roberto Azevêdo highlighted agriculture and the car industry as two of the biggest victims if a deal could not not be struck, due to the heavy tariffs they would be subject to under trade rules.

The Prime Minister still wants an agreement that keeps tariff-free access to EU markets, but insists Britain would still be able to thrive under WTO terms, which will automatically apply if nothing is rubber-stamped by the end of the year, according to The Times. […]

Don’t know if you have ever read Article 50, but it’s designed to drag things out.
  1. Any Member State may decide to withdraw from the Union in accordance with its own constitutional requirements.

  2. A Member State which decides to withdraw shall notify the European Council of its intention.

    In the light of the guidelines provided by the European Council, the Union shall negotiate and conclude an agreement with that State, setting out the arrangements for its withdrawal, taking account of the framework for its future relationship with the Union. That agreement shall be negotiated in accordance with Article 218(3) of the Treaty on the Functioning of the European Union. It shall be concluded on behalf of the Union by the Council, acting by a qualified majority, after obtaining the consent of the European Parliament.

  3. The Treaties shall cease to apply to the State in question from the date of entry into force of the withdrawal agreement or, failing that, two years after the notification referred to in paragraph 2, unless the European Council, in agreement with the Member State concerned, unanimously decides to extend this period.

  4. For the purposes of paragraphs 2 and 3, the member of the European Council or of the Council representing the withdrawing Member State shall not participate in the discussions of the European Council or Council or in decisions concerning it.

    A qualified majority shall be defined in accordance with Article 238(3)(b) of the Treaty on the Functioning of the European Union.

  5. If a State which has withdrawn from the Union asks to rejoin, its request shall be subject to the procedure referred to in Article 49.
Theresa May was never going to do anything like invoke clausula rebus sic stantibus, which would have declared the EU treaties invalid due to the burdens it puts on member states and given the UK a bigger edge in negotiations with this wannabe evil empire. I do not think that Johnson knows what that is, but since these negotiations are in light of this treaty, he had better find out quickly.

How is it that you know what it is and Boris Johnson does not, seeing he has the best lawyers he can hire working for him?

With all due respect, that is argumentum ad verecundiam. Particularly now that the kind of lawyers you mention have to come into question, especially if they have an agenda themselves.

With all due respect, it is not an argument from authority, but an argument from common sense, and much more solid than your presumption that Boris Johnson doesn’t know the finer points of EU treaties.

Citing “lawyers” is the appeal to authority. The profession particularly in politics is much despised, and rightly so; common sense is excluded automatically in that sphere, and regrettably so.

I don’t mean to insult Mr. Johnson, but he needs to be more assertive versus the (clearly anti-UK) EU, just as he has been thankfully assertive with respect to the statue of Winston Churchill. The entire treaty is a farce, hence “rebus sic stantibus” is a valid attack on it.

We will see how the Germans like it when they can’t sell/move parts into the country. Perhaps UK, US, Japanese and Korean products will gain a greater foothold?

Article 50 - together with all other articles - is irrelevant to the current negotiations, since the UK has now left the EU and is no longer bound by them. The current negotiations are about the content, if any, of a new trade deal between the UK and EU. This would take effect once the present transitional arrangements, agreed as part of the UK’s withdrawal deal, end in December.

No, it is a recognition of specialized knowledge. The last carpenter I hired had specialized knowledge; I was not appealing to his authority.

Now you’re employing proof by repeated assertion. The prevalence of lawyers in politics has historically and contemporaneously been to the detriment of rule of law and even of society. I cannot tell if Johnson is acting on lawyers’ advice with respect to negotiations with the EUSSR, so I won’t speculate on that matter.

It would not necessarily be irrelevant to the EU since for them, that treaty is still in force and they would frame negotiations with a former member state through that lens. Plus as you note, this is still hinging on the withdrawal deal per Article 50; hence, rebus sic stantibus could still be invoked based on the actions of the EU even here.
