The Insurrection Act of 1807 is a United States federal law (10 U.S.C. §§ 251255; prior to 2016, 10 U.S.C. §§ 331335) that governs the ability of the president of the United States to deploy military troops within the United States to suppress civil disorder, insurrection, and rebellion.
The general purpose of the Insurrection Act is to limit presidential power, relying on state and local governments for initial response in the event of insurrection. The Posse Comitatus Act prohibits the use of the United States Army and Air Force (which has also been extended by executive direction to the Navy) for routine law enforcement.
They can spot from the air, supply and service vehicles and use them for transport. They can only defend themselves or use weapons when their life or priority A property is threatened. Trump has actually done more than he has to with the assignment of National Guard Troops at title 32 status and used federal funds to pay the bill. And if he had assigned them with title 10, they could have done nothing at all and the states wouldnt pay a thing .and get nothing in return. In theory, If the governors had ordered in the NG, it would have been at title 32 orders and they would have had to pay the bill. Theyre getting off light.

I don’t know if there were .50cals set up in bunkers, but they were mounted on the appropriate vehicles. I remember a member of the church I joined after moving there was talking about that time. He was in the DC National Guard, and he spoke of riding around town in a duece and a half with his M-1 and the .50 cal mounted on it. He said that the ammo can in the feed tray was empty, the MG was merely for intimation, and he though it did a fairly good job.
The Michigan Army National Guard actually had .50 cals with live ammo mounted on some of their vehicles. At one point (in the book I noted) they thought they were under sniper fire and opened up on a couple of buildings in response. It was immediately after that incident that the 82nd Airborne was ordered in to replace the Michigan ARNG. Those MI ARNG folks who remained were stripped of all their live ammunition. The 82nd Airborne soldiers had one 8-round clip displayed on the shoulder strap of their web gear, and were told that if anyone loaded it into their weapon they would be court martialed. The lesson learned was that Regular Army soldiers were much more self controlled in the city and the “fear factor” of the locals, that these were
combat veterans, did the rest.

That was then, this is now. A very large percentage of the National Guard are combat veterans (The 34th Infantry "Red Bulls" replaced my company in Anbar, 2006). Both active and ARNG have hard-core, experienced soldiers, and both sides have knuckleheads as well.
And Ike deployed the 101st to Little Rock in 1957.
Good. Soldiers in full battle gear armed with rifles affixed with bayonets, departing Humvees would make any civilian wet his pants, turn tail, and run.
These fine people can’t even defend themselves in an active warzone. Posse commitatus died with the right to everything else.
Just should have let the places burn until the people decide to defend themselves.

Makes sense that the combat experienced soldiers would have more restraint with their better combat knowledge. OTOH - I’m guessing they aren’t trained as much in riot and crowd control as the police. Hopefully everyone will make wise decisions.
Watching last night in Seattle the police and protesters were trying to work out a plan for the protesters to disperse peacefully and they did. Except for the white guy and the white gal that kept trying to foment rioting.
But the protesters promised to be back today. They are. Last I heard they were marching and chanting and stuff. Sounded fairly controlled. Hopefully it stays like that.

The posse comitatus act, within its very text, allows / authorizes the President to use regular military in the US when the civil authorities in an area fail to secure the Constitutional rights of their citizens.
President Trump paraphrased this in his speech tonight.

Was in G2 with the 82nd when MLK was killed. Set up at the War College. Worked 12 on 12 off. Every morning my driver and I would drive to the poost office an picked up intel reports from 18th Corp. Total lock down. No one on streets so took a different route there and back to sightsee. Also rode a chopper that got to close to White House. Got message as soon as we landed. It said do that again and will shoot you down. :>0 Still have photos of bruned out areas. Went for blocks.
