The judge’s attorney put the best lipstick available on the pig.

But notice that he deviated from the procedures which the brief argues he had a right to employ. Then they argue that his approach was more moderate than what is permitted.

I don’t think anyone would have stopped the judge from ruling on the request before him. If he refused to dismiss then Flynn would appeal it.

What the judge actually did was to delay things and to set up a special procedure that seemed like he was acting out of anger rather than caution.

His attorney also seemed to argue that he was being prevented from evaluating or investigating the case before him. But bringing in someone to make arguments for one side is not the same as asking the actual parties before him to give him facts.

If you haven’t read it, basically the judge is claiming he just needed more time to evaluate the contempt citation he was contemplating. He did not argue the specific case law and legal precedents the court had listed in their ruling for judge Sullivan to explain his actions.

To put a fine pencil on it, Judge Sullivan (actually, his defense lawyer) simply argued that he needed more time to contemplate a contempt charge against General Flynn because Flynn had pled guilty in court proceedings presided over by two different judges.

The problem for Sullivan, besides not addressing at all the specific case law cited by the higher Court, is that he is arguing a contempt charge may be in order and essentially proposing that it may be appropriate for him to punish the victim of prosecutorial misconduct for allowing the obvious malfeasance of both the justice department and his original lawyers to effect his plea.

If that behavior is not egregious enough, if you remember, in his public statements to the defense he claimed that he was considering a perjury charge as well as the contempt charge... which reveals that his response to the court is disingenuous at best.

His response is weak and effectively bullshit and I fervently hope the court is not so corrupted by politics that the correct decision cannot be rendered.

Sounds like Sullivan is saying that he is in charge of deciding whether Flynn lied or not, and that he’s certain that Flynn said he lied a couple of times.

He also wonders if the lies about Turkey are to be overlooked even though they aren’t part of the charges.

He thinks all of this lying about lying is contempt.

He mentions no place that the bases of the charges have been disproven! That means the only way to get a guilty plea out of an innocent man is to mislead, manipulate, and coerce.

Sullivan is insisting on executing a man that DNA proves did not commit the murder.

More tip toe through the swamp tulips sophistry from the coupists simply because Gaspipe Barr refuses to drop the hammer on them. They need a political, criminal and civil court carpet bombing until they cry uncle. But that won’t be happening because the GOPe have no interest in supporting POTUS against the coup.
