A federal judge on Friday dismissed a $10 million defamation lawsuit by One America News (OAN) against Rachel Maddow, finding that a "reasonable viewer" would know the MSNBC prime-time host was only offering her opinion when she called the right-leaning network "paid Russian propaganda."
"Maddow had inserted her own colorful commentary into and throughout the segment, laughing, expressing her dismay (i.e., saying 'I mean, what?') and calling the segment a 'sparkly story' and one we must 'take in stride,'" Judge Cynthia Bashant wrote Friday.

The grammar police told us it would be the end of civilization if we let "literally" mean "not literally," and they may have had a point after all.
Basically, case dismissed on the grounds that no reasonable person would believe anything Rachel Maddow says.
If the judge had made that explicit, rather than just implicit, and downgraded her to just another unfunny tv satirist, I might go along.
As it is, though Maddow is going to go on making stuff up and her fans are going to go on believing her.

Judge Bashant should be disbarred for violating the Constitution and then investigated for bribes from Mexican drug cartels. A reasonable reader should recognize that this is my opinion.
Cynthia Bashant is the judge who in 2002 approved the search warrants for David Westerfield, based on an affidavit which was riddled with errors. And the only question she asked was about his polygraph exam. So she just acted as a rubber stamp. Guilty until proven innocent. Actually, the whole of law enforcement treated him as just “guilty”, right from the start.
OAN should appeal, obama judges have a real habit of getting overturned on appeal.

That is a statement of fact, not of opinion. If she had said "sounds like paid Russian propaganda" while acknowledging it was false, that could be construed as an opinion...possibly.
IIRC the case hinged on the fact that one person working for OAN also worked for a Russian news agency.
