Texas Attorney General Ken Paxton Challenges Keystone Pipeline Ruling

Texas Attorney General Ken Paxton, working with counterparts in 17 other states, has filed a friend-of-the-court brief in a West Coast federal appeals court criticizing a lower court’s decision that will could delay oil and gas pipeline projects.

U.S. District Judge Brian Morris in April canceled an environmental permit for the long-delayed Keystone XL oil pipeline in Montana. Morris said that the U.S. Army Corps did not adequately consult with the U.S. Fish and Wildlife Service on risks to endangered species and habitat when it renewed a nationwide permit in 2017 that allows dredging work on pipelines across water bodies. To allow the agency to continue authorizing new oil and gas pipeline construction “could seriously injure projected species and critical habitat,” the judge ruled.

“The district court incorrectly placed a burden on all pipelines, and that decision must be stayed in order to ensure that ongoing construction continues smoothly and no communities that rely on these growing pipelines are left without utilities vital to their practical and financial survival,” Paxton said.

The brief was chiefly authored by Texas and West Virginia. Other states participating are Alabama, Alaska, Arkansas, Georgia, Indiana, Kansas, Kentucky, Louisiana, Missouri, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota and Utah.

Another radical Obama judge strikes again.

The amicus brief filing Friday, asked the San Francisco-based 9th District Court of Appeals to stay the Montana judge’s ruling. We can only hope that Trump has appointed enough judges in the 9th circus to get the stay.

Ken Paxton is one of the best Texas Attorneys General ever!

We are under attack by Marxist judges and the rest of the leftist cadre.

These filth must be stopped. Why must we have to tip toe around while the Marxists are out to destroy us. They crap on the constitution and we have to play lawyer games with those whose sole purpose is destruction of America.

I noticed that New Mexico was not one of the states that joined Texas. Our state AG is a Dem lib and our radical Dem governor is mentioned as a minority female on Biden’s ticket.

This is the 2nd time that this Obama judge has issued a ruling meant to throw obstacles in the Keystone Pipeline completion.

So the Judges can now determine what is adequately consulting with another government agency? The last I looked the U.S. Fish and Wildlife Service was under the Executive Branch of the US Government and with the three separate powers of our Government, the courts no control over the Fish and Wildlife Service. Also what expertise does the judge have in the topic under consideration?

It would be a hoot if the energy producing states were to form a consortium, build the pipeline anyway and when the Yankees come begging for energy, give them all the finger.

Here’s the deal. I’m from a “Yankee “ State. We had the opportunity to have a natural gas pipeline put in but Cuomo didn’t want to help out the American carbon industry. So NY pays extra to get natural gas delivered by ship from.....wait for it.....Russia.

Enjoy living in America. Perhaps I’ll join you one day.

Just another delaying tactic based on hope. Biden said he’d kill the project.

The blowback is that it supports energy prices at a good time for that. Do whatever you like judge, it will all work out in the end.
