But, and here’s the run, we need to deal with the poison pill that is Frothingham v. Mellon that subverted the long held right of citizens to pursue a private prosecution of a public right (I.e, sue the government when it exceeds its delegated powers).

A government "exceeding its delegated powers" isn't the real issue here. A government violating the rights of it citizens is absolutely a legitimate issue for a Federal lawsuit. That's why these churches that have been shut down have been filing lawsuits and getting restraining orders against states, towns, police departments, etc. in place through Federal courts.
